يتناول هذا البحث موضوع (الفتوى على خلاف ظاهر الرواية دراسة تطبيقية على كتاب القضاء) حيث بينت فيه مصطلح ظاهر الرواية عند علماء الحنفية وتكتبه وعلامات الإفتاء وقواعد الترجيح بينها ومراتبها، وكذا أسباب عدول متأخري الحنفية عن الفتيا بظاهر الرواية، وطبقت ذلك كله على مسائل القضاء عندهم. وتأتي أهمية هذه الدراسة من كونها تسلط الضوء على موضوع الإفتاء والحكم بخلاف ظاهر الرواية وإظهار مرونة الفقه لحنفي في تعاطيه مع المسائل التي تغير الحكم فيها بتغير الزمان والعرف في تلك المسائل. وقد خلصت الدراسة إلى أن توضيح أسباب الفتيا بخلاف ظاهر الرواية وأنها تعود إلى ستة أسباب، وإلى وجود مسائل عديدة تطبيقية في الفقه الحنفي في القضاء خالفوا فيها الفتيا بظاهر الرواية وذلك لسبب نصوا عليه في كتبهم.
This research deals with the topic of (the fatwa in contrast to the apparent narration of the novel, an applied study on the book of the judiciary), where the term zahir narration according to the Hanafi scholars and his books, the signs of fatwas and the rules of weighting between them and their ranks, as well as the reasons for the abandonment of the latter’s decision from the fatwa apparent in the narration, and applied all this to their judicial issues. The importance of this study comes from the fact that it sheds light on the subject of fatwas and rulings, contrary to the apparent meaning of the narration, and to show the flexibility of Hanafi jurisprudence in dealing with issues that change the ruling in them with the change of time and custom in those issues. The study concluded that the explanation of the reasons for the fatwa is different from the apparent meaning of the narration and that it goes back to six reasons, and that there are many practical issues in the Hanafi jurisprudence in the judiciary in which they differed the fatwa from the apparent meaning of the narration, for one of the reasons.
