|a نتناول في دراسة المصادرة الإدارية على وسائل الإعلام الاختلاف في النصوص القانونية والإجراءات التي تضعها الدول المقارنة في تشريعاتها مع القوانين والتعليمات العراقية والتي من شأنها ترد قيدا على حق الملكية الخاصة تمنحه للإدارة عندما تقوم في دورها الرقابي على وسائل الإعلام, فالاختلاف بين النصوص أو التعليمات أو الإجراءات التي يحدد من فرض جزاء المصادرة على وسائل الإعلام سواء إكانت مقروءة أم مسموعة أم مرئية تقليدية كانت أو إلكترونية, يوضح مدى تمتع حرية الإعلام من جانب ومن جانب أخر يبين كيفية حماية النظام العام والحفاظ على حقوق وحريات الآخرين, والمصادرة تعني نزع ملكية الشيء جبرا عن مالكه وإضافته إلى ملك الدولة بغير مقابل, فهي إما أن تكون بصفة عقوبة جنائية إذا جرت بحكم من المحكمة المختصة، أو تكون ذا صفة إدارية إذا منحت بموجب تشريع. وللوقوف على سلطة الإدارة في فرض جزاء الإدارة وسائل الأعلام سواء كانت تمنح لها بشكل إجراءات للحصول على أذن أو ترخيص نتيجة لمخالفة شكلية، أو تحدد لوسائل الإعلام بعض من القيود العامة أو الخاصة على المحتوى الإعلامي غير المسموح لها بنشرها أو تداولها أو بثها وتسمى المخالفة الموضوعية، وما مدى سعي الإدارة في فرض جزاء المصادرة تحقيق النظام العام ومصلحة المجتمع.

Confiscation means expropriating the object by force from its owner and adding it to the state’s property without compensation. It is either as a criminal. punishment if it is carried out by a judgment of the competent court, or it is of an administrative character if granted by legislation. To find out the authority of the administration to impose the administration’s penalty on the media, whether they are granted in the form of procedures to obtain permission or license as a result of a formal violation, or specify to the media some of the public or private restrictions on media content that are not allowed to be published, circulated or broadcast and are called substantive violations, To what extent does the administration seek to impose the confiscation penalty to achieve public order and the interest of society.
