المستخلص: يهدف هذا البحث إلى تسليط الضوء على بعض جرائم القتل بالوسائل النفسية وبيان مدى خطورتها على الفرد والمجتمع، كما يتناول العقوبات التي فرضها الفقه الإسلامي من أجل التصدي والقضاء على هذا النوع من القتل، فالخوف الشديد والفزع قد يؤديان إلى الموت، والضغط النفسي الشديد قد يؤدي إلى الموت، وكذلك العين والسحر قد يؤديان إلى الموت، والمحافظة على النفس البشرية من أهم مقاصد الشريعة الإسلامية. وقد توصل البحث إلى العديد من النتائج، من أهمها: ١- وجوب قتل من يحبس إنسانا ويمنع عنه الطعام والشراب؛ قاصدا قتله أو تعذيبه بأي وجه من الوجوه حتى الموت. ٢ - وجوب الدية على من أفزع امرأة حتى ماتت أو أجهضت جنينها. 3- وجوب الدية على من صاح ببالغ فمات من صيحته. ٤- وجوب القصاص على من أتبع إنسانا بسيف أو نحوه فمات أو وقع في شيء هلك به. 5- إذا تسبب شخص في موت غيره قهرا بأفعال محرمة كالسب والإهانة والضرب بغير حق، وأثبت الطب الشرعي أن وفاته كانت نتيجة السباب الذي تعرض له، فيتحمل كل من سبه وزر وفاته، وتلزمهم شرعا دية هذا الرجل. 6- وجوب القصاص أو الدية على العائن الذي يقتل بعينه إن تكرر ذلك منه وصار له عادة واشتهر بين الناس بذلك. 7- إذا ثبت إضرار الساحر بسحره أو قتل به ولو بغير مكفر، يقتل لسعيه بالفساد في الأرض، ودفعا لشره كالخناق وقطاع الطريق. كما أوصى الباحث بضرورة عقد ندوات لبيان خطورة هذا النوع من القتل على الفرد والمجتمع، والتصدي له، والقضاء عليه.

This research aims to shed light on some crimes of murder by psychological means and to show the extent of their danger to the individual and society. It also deals with the penalties imposed by Islamic jurisprudence in order to confront and eliminate this type of killing. Intense fear and panic may lead to death, and severe psychological pressure may lead to death. Likewise, the eye and magic may lead to death, and preserving the human soul is one of the most important purposes of Islamic law. The research reached the most important results, the most important of which are: 1- The obligation to kill someone who imprisons a person and prevents him from eating and drinking with the intention of killing or torturing him in any way until he dies. 2- The obligation of blood money for someone who frightened a woman until she died or miscarried her fetus. 3- The obligation of blood money for someone who shouted an adult and died as a result of his shouting. 4- The obligation of retaliation for someone who pursues a person with a sword or the like, and he dies or falls into something that perishes him. 5- If a person causes the death of another by forceful actions such as insulting, insulting, and beating unjustly, and forensic medicine proves that his death was the result of the insult he was subjected to, then everyone who insulted him bears the burden of his death, and they are legally obligated to pay the blood money for this man. 6- The obligation of retaliation or blood money for the aggrieved person who kills himself, if this is repeated by him and becomes a habit for him and becomes famous among the people for that. 7- If it is proven that the sorcerer was harmed by his magic or was killed by it, even without expiation: he shall be killed for his efforts to spread corruption in the land and to ward off his evil such as stranglers and bandits. 8- The sorcerer must repent, if he repents, otherwise he will be killed if what he is bewitched with is clear words of blasphemy, and if what he is bewitched with is words that are not blasphemy, and he did not harm anyone with it, he is forbidden from it, and if he repeats it, he is punished. The researcher also recommended the need to hold seminars to demonstrate the seriousness of this type of killing on the individual and society and to confront and eliminate it.
