Copyright protection and related rights remains one of the most important issues in intellectual property. The continuous development of new technologies and the advent of digital technology and Internet triggered off many questions which appeared in this field, in particular the widening of the scope of protection of creations relevant to new technologies, confronted with the strengthening of users' rights by multiple opportunities offered by these technologies. As a matter of fact, a balance of power was established in this field which could upset copyright foundations. La protection du droit d’auteur et des droits voisins demeure l’un des sujets les plus importants en propriété intellectuelle. Le développement continu des nouvelles technologies et l’avènement du numérique et internet font apparaitre de nombreuses questions qui émergent dans ce domaine, en particulier l’élargissement du champ de protection des créations relevant des nouvelles technologies, confrontées au renforcement du droit des utilisateurs par les multiples opportunités offertes par ces dernières technologies. De ce fait, un rapport de force s’installe dans ce domaine qui peut bouleverser les fondements du droit d’auteur. |
