المستخلص: إن من أعظم المسائل التي جاءت بها الشريعة الإسلامية: حقوق ولي الأمر في الشريعة، والعلاقة بين الحاكم والمحكوم، وقد حددت الشرعية حقوق الراعي على رعيته، والرعية على الراعي. وفي هذا البحث بيان لحقوق ولي الأمر في باب هو من أهم أبواب الفقه الإسلامي؛ وهو باب الحدود. كما بين الباحث حكم نصب الإمام، وأهمية هذا المنصب، وأن ولاية أمر الناس من أعظم واجبات الدين. كذلك بين كلام الفقهاء في حقوق ولي الأمر في إقامة الحدود، وهل لغير الإمام تنفيذ ذلك؟ وأن الأقرب -وهو ما عليه العمل- أنه ليس لغير الإمام أو نائبه استيفاء الحدود، ولا يتم تنفيذ الحدود إلا بحضور الإمام أو نائبه. كما بين البحث المراد بأهل البغي، والخوارج، والفرق بينهما، وحكم قتال أهل البغي والخوارج مع الإمام

Indeed, among the most prominent issues brought by the Islamic Sharī’ah is: the legal rights of the leader, and the relationship between the leader and the people, and the Sharī’ah has defined the rights of the leader over his people and those of the people over their leader. And among the chapters where the rights of leader were mentioned, among the most significant chapters of Fiqh (Islamic jurisprudence), is the chapter of the defined punishments (ḥudūd). In this paper, the researcher explained the ruling of appointing a leaser, and the significance of this position, and that presiding over the affairs of people is among the most significant obligations in the religion. Also, it mentioned the opinions of the jurists regarding the rights of the leader in implementing the defined punishments, and are persons other than the leader permitted to implement them? And that the most preponderant, which is the extant position, is that it is not permitted for persons other than the leader or his appointee to implement the defined punishments, and that the implementation of the defined punishments is not complete until the leader or his appointee is present. The paper also mentioned what is meant by Ahl Al-Bagy (the dissidents), Al-Khawārij (the khārijites), and the difference between them, and the ruling of fighting Ahl Al-Bagy and Al-Khawārij along with the leader.
