المستخلص: نظرا لأهمية العيش في أمن واستقرار بعيدا عن الاضطراب والفوضى؛ تظافرت الأدلة التي تحض على ما يسهم في توطيد الأمن في المجتمع المسلم ومنها النصوص المتعلقة بالسمع والطاعة للإمام، والتحذير من الافتئات والخروج عليه ولزوم كلمة المسلمين. ونظرا لتنوع صور الخروج على ولي الأمر جاءت هذه الدراسة التي تهدف للتعرف على المنهج الشرعي في التعامل مع موضوع التحريض على ولاة الأمر وإبراز صور التحريض على الولاة، وبيان المنهج الشرعي في التعامل مع المحرضون على الولاة. والمنهج المستخدم في هذه الدراسة المنهج الاستقرائي: وكذلك المنهج التحليلي الكيفي. ومن نتائج هذه الدراسة: إن من القواسم المشتركة بين المحرضين المتقدمين والمعاصرين: استغلال أوقات الأزمات، الجهل، عدم إنزال الولاة منازلهم، التزهيد بالعلماء الراسخين. ومن صور التحريض على ولي الأمر: (الإنكار العلني على ولي الأمر، التشهير بأخطاء الحكام، الإرجاف، التهوين من قدر الولاة، دعاوى الإصلاح، إثارة الشبهات). ومن طرق التعامل الشرعي مع المحرض على ولي الأمر: (النصح، الحوار والمناظرة، ذم المحرضين، ترك مجالسة المحرضون والتحذير منهم، الشدة في المعاملة والتعزير، دعوتهم للتوبة).

Study summary: Due to the importance of living in security and stability, away from turmoil and chaos; Evidences that contributes to the consolidation of security in the Muslim community have combined, including texts related to hearing and obedience to the imam, warning against rebellions and hatred of him and the necessity of the word of Muslims. And given the various forms of rebellions, both real and incorporeal, by hand and tongue; This study aims to identify the legal approach in dealing with the incitement to guardian, highlighting the images of incitement to the guardian, and indicating the legal approach to dealing with the instigators of the guardian The approach used in this study is inductive: by following the past and recent forms of incitement to the guardian, as well as in dealing with the instigator of a guardian through legal texts and the critical approach One of the findings of this study is that modern and contemporary instigators have common denominators: exploiting crisis times,, ignorance, underestimation of the guardians, and contempt for established scientists the forms of incitement to a guardian: (public denial of the guardian, defamation of the rulers' mistakes, enumeration of their defects, shuddering, underestimation and devaluation of the guardians, calls for reform, raising suspicions). The legal ways of dealing with the instigators of the guardian are: advice, dialogue and debate to detect suspicions, vilification of instigators and their works, abandonment of and warning of instigators, harsh treatment and humiliation, calling them to repent and return to the right).
