المستخلص: يحاول هذا البحث الوقوف على جملة الضوابط والعناصر التداولية التي اعتمدها علماء أصول الفقه كمعايير للتميز بين الدلالات الحقيقية والمجازية للخطاب التكليفي، والتي يمكن إجمالها في سبعة ضوابط أساسية، منها ما يرتبط بالوضع اللغوي باعتبار الخطاب التكليفي قولا دالا على الطلب من الغير، ومنها ما يتعلق بسياق الكلام ومقامه من حيث صدور الخطاب من الأعلى إلى الأدنى في سياق الاستعلاء مما يشعر بوجوب الطاعة، كما منها ما يرتبط بمقصدية المتكلم من حيث إرادة الفعل أو كراهته.

This research is a contemporary linguistic study that examines the criteria adopted by the Jurisprudence scholars to distinguish between both the real and unreal meanings of commands and prohibitions, which relate to the linguistic situation, context, and what the speaker intends. The research also seeks to uncover the basis of disagreement between them in determining the real meaning of commands and prohibitions formulas.

Cette recherche est une étude linguistique contemporaine qui examine les critères retenus par les érudits de la jurisprudence pour faire la distinction entre les significations réelle et irréelle des commandements et interdictions, qui se rapportent à la situation linguistique, au contexte et à ce dont le locuteur parle. La recherche vise également à découvrir le fondement du désaccord entre eux pour déterminer le sens réel des formules de commandements et d’interdictions.
