المستخلص: اقتناعا منه بضرورة استكمال بناء المؤسسات الدستورية التي تعد أساس قيام دولة القانون، وإيمانا منه بوجوب خلق نوع من التوازن والاستقرار داخل هيكل النظام الدستوري الجزائري، بادر المؤسس الدستوري في التعديل الدستوري لسنة 2020 لوضع معالم القضاء الدستوري من خلال إنشاء المحكمة الدستورية بوصفها مؤسسة مستقلة مكلفة بضمان احترام أحكام الدستور، هذه المحكمة التي تتميز بنوع من السمو في مقابل الأجهزة والمؤسسات الدستورية الأخرى، كما تتميز بنوع من الخصوصية الوظيفية في ممارسة اختصاصاتها وصلاحياتها في الرقابة على دستورية القوانين والتنظيمات ومدى احترام السلطات العمومية المختلفة لنصوص الدستور، مستخدمة في سبيل ذلك جميع الوسائل والآليات التي تراها مناسبة المحددة في الدستور نفسه وفي نظامها الداخلي.

Convinced of the need to complete the building of constitutional institutions, which are the basis for the establishment of the state of law, and his belief in the necessity of creating a kind of balance and stability within the structure of the Algerian constitutional system, the constitutional founder took the initiative in the constitutional amendment of the year 2020 to set the parameters of the constitutional judiciary through the establishment of the Constitutional Court as an independent institution charged with ensuring Respect for the provisions of the constitution, this court, which is characterized by a kind of highness compared to other constitutional bodies and institutions, and is also characterized by a kind of functional specificity in the exercise of its competences and powers in monitoring the constitutionality of laws and regulations and the extent to which the various public authorities respect the provisions of the constitution, using for this purpose all the means and mechanisms that It deems appropriate as specified in the Constitution itself and in its by-laws.
