المستخلص: تهدف الدراسة لتوضيح الأهمية الاستراتيجية لحماية حقوق الملكية الفكرية بالنسبة للشركة الناشئة، كونها شركات تطمح للنمو السريع انطلاقا من أفكار إبداعية ابتكارات قابلة للتحسين، ونظرا لتعرض أفكارها لخطر السرقة والانتهاك من قبل المنافسين من الشركات الكبرى التي تملك إمكانيات أكبر منها، إضافة لبحثها الدائم عن التمويل وكذا وضع استراتيجية خروج فعالة، لذا تسعى بشتى السبل للتخفيف من حدة المخاطرة ومن بين أهم وسائلها في تحقيق هذا الهدف حسن إدارة ملكيتها الفكرية لاختراعاتها وإبداعاتها الفكرية، تم التوصل في الأخير إلى إدارة محفظة الملكية الفكرية للشركة الناشئة بالشكل وفي الوقت المناسب، تمكنها من الاستفادة من الابتكار الذي عملت جاهدة على تطويره وحمايته من النسخ والسرقة، وتضمن تفوق منتجاتها وخدماتها على منافسيها كما تمكنها من تحقيق أفضل مردود كما وتعزز من قيمة الشركة، من خلال الاتفاقات السرية الخاصة بنقل الملكية وتسجيل براءات الاختراع والعلامات التجارية وغيرها من الأصول الفكرية تتمكن الشركة الناشئة من تعزيز موقفها التفاوضي في حالة البحث عن جذب مستثمرين محتملين، إلى جانب ضمان حقها في حالة سرقة وانتهاك باسترداده أو التعويض.

The study aims to clarify the strategic importance of protecting intellectual property rights for the emerging company, Being companies that aspire to rapid growth based on creative ideas and innovations that can be improved. And due to the exposure of its ideas to the risk of theft and violation by competitors from major companies that have greater capabilities than them. In addition to its constant search for financing, as well as the development of an effective exit strategy. Therefore, it seeks by various means to mitigate the risk, and among its most important means in achieving this goal is the proper management of its intellectual property for its inventions and intellectual creations. Finally, it was reached to manage the intellectual property portfolio of the emerging company in a timely manner, enabling it to benefit from the innovation that it worked hard to develop and protect it from copying and theft, and ensuring the superiority of its products and services over its competitors. It also enables it to achieve the best return and enhance the value of the company. Through confidential agreements for the transfer of ownership and the registration of patents, trademarks and other intellectual assets, the startup company can strengthen its negotiating position in the event of searching for potential investors, In addition to ensuring its right in the event of theft and violation to recover it or compensation.
