هذه الورقة البحثية مستلة من رسالتي العلمية في مرحلة الماجستير، الموسومة بعنوان "تخريجات الأصحاب للمسائل الفقهية التي توقف فيها الإمام أحمد -رحمه الله - جمعا ودراسة"، وتتناول هذه الورقة أحد أنواع التخريج التي قلما تطرق إليها الباحثون دراسة ومناقشة، وهو "تخريج الأصول من الأصول"، وقد اشتمل البحث على مقدمة، ومبحثين، وخاتمة، أما المقدمة فاشتملت على بيان أهمية البحث، وسبب اختياره، والمنهجية المتبعة في البحث وخطته. يبرز هذا البحث مصطلح "تخريج الأصول من الأصول"، ويسعى إلى الوصول إلى تعريف جامع مانع ينظم ما يندرج تحته من صور، مع بيان أن الأصوليين قد عمدوا إلى القواعد الأصولية فخرجوا منها قواعد أصولية، وإبراز أنهم لم يقصروا ذلك على استنباط الأحكام الشرعية الفرعية من القواعد الشرعية الكلية، أو القواعد المذهبية، متبعة في ذلك المنهج الاستقرائي في جمع أقوال العلماء في معنى التخريج، والمنهج الوصفي في عرض أقوالهم، والتحليلي والاستنتاجي في مناقشة الأقوال محاولة الوصول إلى تعريف مختار للتخريج. وخلص البحث إلى تعريف ضابط لمصطلح "تخريج الأصول من الأصول"، وبيان أن هذا النوع طريق إلى دراسة علل القواعد الأصولية ومآخذها، والقواعد المقاصدية، وتنقيح القواعد الدخيلة المبنية على أصول فاسدة شرعا أو عقلا أو لغة، وأن تخريج الأصول من الأصول تندرج تحته صورتان: أولاهما استنباط القاعدة الأصولية من مصادر التشريع، أو من اللغة، أو العقل، أو مقاصد الشريعة، والثانية: استنباط قاعدة أصولية من قاعدة أصولية منصوص عليها.
This paper is derived from my Master's Scientific Thesis, tagged "Alumni Alumni for the questions of jurisprudence in which Imam Ahmed stopped - Mercy of God - Collect and study ". This paper addresses one of the types of graduation that researchers have said to study and discuss, namely" The graduation of assets from assets ". The research included an introduction, researchers, and a conclusion. The introduction included a statement of the importance of the research, the reason for its selection, and the methodology and plan of the research. This research highlights the term "asset graduation", and seeks to arrive at an overarching, prohibitive definition that regulates the underlying images. With the explanation that the fundamentalists deliberated on the fundamentalist rules, they left them with fundamentalist rules. and highlighting that they have not been limited to deriving subsidiary sharia provisions from the overall sharia rules, Or the doctrinal rules, followed in that inductive approach of gathering scientists' words in the sense of graduation, The descriptive approach to presenting their statements, and the analytical and conclusive approach to discussing statements, attempted to arrive at a selected definition of graduation. The research concluded that a controlled definition of the term "asset graduation" was a way of examining the ills and sorts of fundamentalist rules, intentional rules and revising extraneous rules based on legitimately corrupt assets, mind or language, and that "asset removal from assets" included two images: The first is to derive the fundamentalist rule from the sources of legislation, from the language, mind or purposes of sharia law, and the second is to derive a fundamentalist rule from a constituent rule.
