1- يهدف هذا البحث إلى تتبع حكم التشريع في كتاب الصلاة عند الحنابلة، من كتاب الآذان والإقامة إلى كتاب صلاة التطوع، وجمعها، ودراستها؛ ليسهل رجوع الفقيه، وطالب العلم إليها، خاصة في هذا الزمن الذي كثر فيه سؤال الناس عن الحكم التشريعية للأحكام. وقد اعتمدت فيه على المنهج الاستقرائي الوصفي. وقد اشتمل هذا البحث على مقدمة، ومبحثان، وخاتمة. المقدمة: اشتملت على أهداف البحث، وأهمية البحث، وأسباب اختياره، ومنهج البحث، وحدود البحث، والدراسات السابقة، وهيكل البحث. المبحث الأول: ويشتمل على التعريف بحكمة التشريع، وأهمية معرفتها للمكلف، والمجتهد. المبحث الثاني: تناولت فيه جمع حكم التشريع عند الحنابلة من مصنفاتهم في الفقه، والتفسير، وشروح الحديث وترتيبها على الأبواب الفقهية، ودراستها. الخاتمة: اشتملت على عدة نتائج ظهرت لي خلال بحثي، من أهمها الآتي: 1. معرفة حكم وأسرار التشريع، وتأملها، وتحصيل مكنوناتها، له فوائد عظيمة وجليلة، ومن هذه الفوائد ما هو عام للمكلفين، ومنها ما هو خاص بأهل النظر والاجتهاد. 2. أبواب العبادات مشتملة على حكم كثيرة، حتى في الأحكام الموصوفة بأنها تعبدية، فالشريعة منزهة عن العبث، والخلو من الحكمة، وقد وقفت الباحثة في الجزء المعني بالدراسة على تسعة حكم.
This research aims to addressed wisdoms of legislation in the book of prayer according to the Hanbalis, from the beginning of the book of the call to prayer and the iqama to the end of the book of voluntary prayers, and to collect them; To make it easier for the jurist, and the seeker of knowledge, to refer to it, especially in this time when people frequently ask about the legislative provision of rulings. It based on a descriptive inductive approach. This research included an introduction, two chapters, and a conclusion. Introduction: It included the objectives of the research, the importance of the research, the reasons for its selection, the research methodology, the limits of the research, literature review, and the research structure. First chapter: It includes defining the wisdoms of legislation, and the importance of knowing it for the mature and the seeker of knowledge. Second chapter: I addressed with the gathering of the wisdoms of legislation according to the Hanbalis from their compilations in jurisprudence, interpretation, and explanations of the hadith, arranging them on the jurisprudential chapters, and studying them. Conclusion: It included several results that appeared to me during my research, the most important of which are the following: 1. Knowing the rulings and secrets of legislation, contemplating it, and obtaining its contents, has great and superb benefits, and some of these benefits are general for the mature, and some of them are specific to the people of reasoning and seeker of knowledge. 2. The chapters on acts of worship contain a lot of wisdoms, even in rulings that are described as devotional, Sharia is far from absurdity and devoid of wisdom, and the researcher focused in the part concerned with the study on nine wisdoms.
