Abstract: هذه الدراسة بعنوان (المسائل الفقهية المتعلقة باليسير المعفو عنه في الشريعة- جمعا ودراسة)، وقد استهدفت الدراسة بيان أهمية دراسة النوازل الفقهية المعاصرة المتعلقة باليسير المعفو عنه في الشريعة، وإظهار الحكم الشرعي فيها، وإظهار جانب الرحمة واليسر في الشريعة من خلال نماذج فقهية معاصرة، ومن أجل تحقيق هذه الأهداف اتبع الباحث المنهج الوصفي، والمنهج التحليلي، وكذلك المنهج المقارن: وذلك بالمقارنة بين أقوال الفقهاء وتأصيلها، وبين نتائج العلم المعاصر. للوصول إلى القول الراجح، وقد انبثقت مشكلة الدراسة من كون هذا البحث جزءا من منظومة الفقه المعاصر الذي تحفه مستجدات تحتاج إلى حل فقهي، وتتركز مشكلة البحث بوجود فراغ في أمر يتعلق بأحد فروض الأعيان، وركن من أركان الإسلام، حيث إن النوازل المعاصرة غير مدروسة الدراسة الاجتهادية التأصيلية المحققة، أما أهمية الدراسة، فكونها تربط بين تقعيدات الفقهاء وتقرير العلم الحديث؛ ليقيم الناس ركنا من أركان الإسلام على الوجه الشرعي الصحيح، وقد توصلت الدراسة إلى مجموعة من النتائج؛ لعل أهمها: قاعدة "اليسير مغتفر" تدخل في جملة القواعد التابعة لقاعدة كبرى: "المشقة تجلب التيسير، ويعفى عن اليسير فقط، وهو القدر الذي يتعافاه الناس في العادة، وقد أوصى البحث بمجموعة من المقترحات أو التوصيات؛ أبرزها: الاهتمام بدراسة الموضوعات المتعلقة بموضوع هذه الدراسة من النواحي الأصولية، وضرورة تناول هذا الموضوع من خلال المناهج الجامعية وقبل الجامعية.

This study is entitled (jurisprudential issues related to the few who are forgiven in the Sharia - a collection and a study). In order to achieve these goals, the researcher followed the descriptive approach, the analytical approach, as well as the comparative approach: by comparing the sayings of the jurists and their roots, and the results of contemporary science. In order to reach the most correct saying, the problem of the study emerged from the fact that this research is part of the system of contemporary jurisprudence that is surrounded by developments that need a jurisprudential solution. As for the importance of the study, it links the rules of jurists with the report of modern science; For people to establish one of the pillars of Islam in the correct legal manner, and the study reached a set of results; Perhaps the most important of them: the rule of “little is forgiven” is included among the rules that follow a major rule: “hardship brings ease, and only the little is forgiven, which is the amount that people usually recover from. This study is in terms of fundamentalism, and the need to address this subject through university and pre-university curricula.
