المستخلص: يتناول البحث وفقا للمنهج الوصفي التحليلي، موضوعا مهما يتصل بأمر يشغل بال العالم باسره في الوقت الحاضر وقد يتكرر في المستقبل، وهو يتناول الحقوق المتصلة بالوقاية والعلاج من مرض فيروس كورونا المستجد "كوفيد ١٩"، ومشاكلها القانونية التي تتصل بحقوق الإنسان، ومدى توافق الإجراءات التي اتخذتها الدول مع طبيعة ومضمون هذه الحقوق وقواعدها المستقرة منذ عقود لمعرفة مدى ملاءمتها للواقع الجديد، والوقوف على تحديات كفاية مضامين هذه الحقوق لهذا الواقع، والبحث في تنازع الحقوق والترجيح والموازنة بينها وفقا للقواعد القانونية الثابتة والأحكام القضائية بهذا الخصوص، وقد توصل البحث إلى نتائج وتوصيات دقيقة حول تحديد الحقوق اللازمة للوقاية والعلاج من مرض كورنا المستجد "كوفيد ١٩"، والضوابط والشروط اللازمة للإجراءات الرامية إلى تقييد الحقوق والحريات بقصد الوقاية من هذا المرض، ومدى تأثير الإمكانيات المادية على واجبات الدول بهذا الخصوص، ومسألة التعاون الدولي في هذا المجال، ومبدأ المساواة خلال جائحة كورونا، ومسألة الرضا في العلاج وحدوده والإجبار عليه، وإشكالية احتكار العلاجات واللقاحات الخاصة بهذا المرض.

This research paper applies the analytical descriptive approach to address a topic of international concern, as the topic is likely to reoccur in the future. This issue deals with the rights concerning the prevention and treatment of the emerging coronavirus disease "Covid-19", and the legal issues concerning human rights, the compatibility and suitability of long-standing procedures applied by countries in the context of our new reality. The paper aims at identifying the challenges of the adequacy of the contents of these rights to this reality. In addition, the paper is examining the conflicting rights and attempt to achieve the needed balance in the light of relevant established rules, as well as judicial decisions. This paper proposes specific recommendations to determine the necessary rights for the prevention and treatment of the emerging disease “Covid 19". This is based on our examination of the procedural controls and conditions restricting rights and freedoms to prevent this disease, and the extent to which material capabilities affect the duties of states in this regard; and the issue of international cooperation in this field, the principle of equality during the Corona pandemic. Add to that, the issue of treatment by consent and by force, and the problem of monopolizing treatments and vaccines for this disease.
