المستخلص: هدف الدراسة التعرف على إمكانية مساهمة الوقف الخيري في دعم القطاع التعليمي في العراق من خلال بيان مساهمة الوقف الخيري في دعم القطاع التعليمي بصورة عامة من خلال تجارب دول مختارة وإبراز أهم التحديات التي تواجه الوقف الخيري في العراق. مشكلة الدراسة نظرا لمشكلة القطاع التعليمي في العراق بصورة عامة ومشكلة نقص الأبنية المدرسية بشكل خاص والتضارب في القرارات الأمر الذي يتطلب إيجاد حل لهذه المشكلة من خلال مساهمة الوقف الخيري في دعم القطاع التعليمي. منهجية الدراسة استخدم الباحثان المنهج الوصفي التحليلي وذلك بالرجوع إلى الدراسات السابقة والمجلات والدوريات والمواقع الإلكترونية ذات الصلة بموضوع الدراسة وتحليل تجارب عدة دول لمساهمة الوقف فيها لدعم القطاع التعليمي. استنتج الباحثان الوقف عقد من عقود التبرعات الشرعية في القرآن الكريم والسنة النبوية والجميع أحل على مشروعيته، ساهم الوقف في التاريخ الإسلامي في إنشاء المؤسسات التعليمية المختلفة، التمويل بالوقف له آثار إيجابية في معالجة الكثير من المشاكل الاجتماعية والاقتصادية، تقليل الأعباء المالية التي تتعرض لها الدولة، هنالك تجارب لعدة دول في كيفية استثمار أموال الوقف في دعم قطاعاتهم التعليمية، عدم حصول القطاع التعليمي في العراق على تمويل كاف لكون الاعتماد بالدرجة الأولى على التمويل المركزي للدولة، أغلب القوانين الصادرة من جمهورية العراق هي قوانين وضعية تقليدية، يوصي الباحثان بضرورة استغلال واستثمار الأموال الوقفية من قبل الدولة العراقية لإمكانيتها في تخفيف بعض الأعباء عن ميزانياتها المالية، ضرورة تشكيل لجان عليا لمعالجة المشاكل العالقة فيما يخص الأملاك الوقفية من أجل حصرها وإنهاء النزاع، تطوير الكفاءات والخبرات للعامين في المؤسسات الوقفية العراقية، الاستفادة من تجارب الدول الرائدة في كيفية مساهمة الوقف في دعم القطاع التعليمي.

The aim of the study to identify the possibility of the contribution of the charitable Waqf in supporting the educational sector in Iraq by demonstrating the contribution of the charitable Waqf in supporting the educational sector in general through the experiences of selected countries and highlighting the most important challenges facing the charitable Waqf in Iraq. The problem of the study given "the problem of the educational sector in Iraq in general and the problem of lack of school buildings in particular and the conflict in decisions, which requires finding a solution to this problem through the contribution of the charitable Waqf to support the educational sector. Study methodology The researchers used the analytical descriptive approach by referring to previous studies, magazines, periodicals and websites related to the subject of the study and analyzing the experiences of several Arab countries for the contribution of the Waqf to support the educational sector. The researchers concluded that the Waqf is a contract of legal donations contracts in the Holy Qur’an and the Sunnah of the Prophet, and everyone has resolved its legitimacy. The Waqf contributed in Islamic history to the establishment of various educational institutions. There are experiences of several countries on how to invest Waqf funds in supporting their educational sectors, the educational sector in Iraq does not receive sufficient funding due to the fact that the dependence is primarily on the central funding of the state, most of the laws issued by the Republic of Iraq are traditional man- made laws, the researchers recommend the need to exploit and invest Waqf funds By the Iraqi state for its ability to reduce some of the burdens on its financial budgets, the need to form higher committees to address the outstanding problems with regard to Waqf properties in order to limit them and end the conflict, developing the competencies and experiences of the workers in the Iraqi Waqf institutions, benefiting from the experiences of the leading countries in how the Waqf contributes to support The educational sector.
