|a تضمن هذا البحث تعارض بين حكمين وهما الندب والكراهة، من بين أحكام الشرع عند الجمهور هي: الواجب والندب والتحريم والكراهة والإباحة. وفي بحثي هذا بدأت بالتعريف اللغوي والاصطلاحي للندب والكراهة ثم صورت المسألة، وصورتها أن يرد حكم من الأحكام يطلبه الشارع طلبا غير جازم، ولكن هذا الحكم يتعارض ويتقاطع مع حكم آخر؛ طلب الشارع تركه على الكراهة، وحررت محل النزاع فيها، ثم ذكرت الأقوال في المسألة والأدلة لكل قول، واتبعت برأي الإمام الجويني فيها، ثم أتيت بثلاث فروع مخرجة على الأصل من كتاب نهاية المطلب وبينت أقوال العلماء فيها والأدلة لكل قول ثم اتبعت برأي الإمام الجويني في تلك الفروع، ثم ذيلت البحث فهرسة المصادر والمراجع.
|b This research included a conflict between two rulings, namely scarring and dislike, among the rulings of Sharia according to the public are: duty, recommendation, prohibition, dislike, and permissibility. In this research, I started with the linguistic and terminological definition of scarring and dislike, then I illustrated the issue, and its form is that a ruling from among the rulings requested by the Lawgiver is rejected in a non-conclusive manner, but this ruling contradicts and intersects with another ruling. The Lawgiver asked him to leave him on hate, I edited the subject of the dispute in it, then mentioned the sayings in the matter and the evidence for each saying, and followed the opinion of Imam Al-Juwayni in it, then I came with three branches that are extracted according to the original from the book Nihayat Al-Muttalib and explained the sayings of the scholars in them and the evidence for each saying, then I followed the opinion of Imam al-Juwayni in those branches, then I appended the search by indexing the sources and references.
