المستخلص: عندما يتم شهر إفلاس الشركة، فإن هذا الإفلاس قد يمتد إلى شركائها، وهؤلاء الشركاء قد يكونون مواطنين أو من مختلفي الجنسيات، وهنا يثور التساؤل عن المحكمة المختصة لنظر دعوى إفلاس هؤلاء الشركاء، هل هي محكمة موطن الشريك؟ أم ذات المحكمة التي أشهرت إفلاس الشركة؟ كما قد تصدر المحكمة المختصة حكماً بشهر إفلاس الشركة الأم، أو أن تحكم بشهر إفلاس شركة وليدة، ففي كلتا الحالتين هل يمكن رفع دعوى إفلاس الشركات التابعة للشركة الأم أو مسؤولية الشركة الأم عن شركاتها الوليدة أمام ذات المحكمة مصدرة الحكم بشهر الإفلاس؟ يتناول البحث الإجابة على التساؤلات المطروحة من حيث مدى إمكانية مد اختصاص المحكمة مصدرة الحكم بشهر الإفلاس إلى نظر دعوى إفلاس الشركاء فيها أو مسؤوليتهم، وكذا الأمر بالنسبة لمد الاختصاص بنظر دعوى المسؤولية المقامة على الشركة الأم أو إفلاس الشركات الوليدة التابعة لها في حال شهر إفلاسها، مع التحليل والمقارنة بين التشريعين البحريني والإماراتي على ضوء قانوني الإفلاس والشركات التجارية.

Once a company is bankrupt, this bankruptcy may extend to its share- holders who can be Bahraini citizens or from other nationalities, and so the question arises which competent court will hear the case? Is it the court that declared the bankruptcy or the court in the shareholder's home jurisdiction? The competent court may also issue a judgment declaring the parent company bankrupt, or a judgment declaring the bankruptcy of a sub- sidiary company. In both cases, is it possible to file a lawsuit for bank- ruptcy of the subsidiaries of the parent company or is the parent company liable for its subsidiary companies before the same court that issued the bankruptcy ruling? The research explores the possibility of extending the jurisdiction of the court issuing the bankruptcy declaration ruling to considering the bank- ruptcy case of the partners and their responsibility. In addition to considering the liability lawsuit filed against the parent com- pany in relation to bankruptcy or the bankruptcy of its subsidiary com- panies in the event of their bankruptcy, as well as an analysis and comparison between Bahraini and UAE legislation in light of bank- ruptcy and commercial companies' laws.
