المستخلص: تشكل الدوائر المتكاملة ركيزة من ركائز صناعة التكنولوجيا في العالم، إذ لا غنى عنها في الأجهزة والآلات والمعدات بمختلف أنواعها، وبتوافر مكونات التصميم التخطيطية للدوائر المتكاملة، يحق لصاحبه الحصول على وثيقة حماية تعرف بشهادة تصميم تخطيطي للدوائر المتكاملة من قبل الجهة المختصة بمنح هذه الشهادة في الدولة مانحة الحماية، وقد سبق لنا ببحث سابق مناقشة الدوائر المتكاملة، لذلك خصصنا هذا البحث لمعالجة شروط حماية وتسجيل الدوائر المتكاملة، والآثار القانونية المترتبة على منح هذه الحماية للدوائر المتكاملة والمتمثلة في حقوق والتزامات صاحب التصميم مع بيان الاستثناءات المقررة في هذا الشأن، وباستعراض مسلك المشرع السوري والتشريعات المقارنة في إسباغ هذه الحماية على حد سواء، وباستخدام المنهج الوصفي التحليلي القائم على الآراء والأحكام بشأن القواعد المعنية بحماية الدوائر المتكاملة، واستخدام المنهج المقارن فيما يتعلق بالتشريعات الوطنية محل الدراسة والمتمثلة في القانون 18 لعام 2012 المتضمن أصول منح براءات الاختراع وتسجيلها ونشرها والحقوق الناشئة عن تسجيلها، وقانون حماية حقوق المؤلف رقم 62 لعام 2013. وقد تبين من خلال البحث عدم كفاية القواعد المنظمة الدوائر المتكاملة سواء في التشريع السوري، إلى جانب مناقشة هذه القواعد مع ما تم النص عليه في الاتفاقيات والمعاهدات الدولية ذات الصلة، كاتفاقية باريس واتفاقية التربس واتفاقية واشنطن للدوائر المتكاملة، وقد تضمن البحث عدة توصيات من أبرزها ضرورة وجود قواعد خاصة بالدوائر المتكاملة تكون ملائمة لطبيعتها وعدم اكتفاء التشريعات محل البحث بإحالة إلى القواعد المنظمة لبراءة الاختراع وإغفال قانون حماية حقوق المؤلف وتطبيق قواعده في معرض حماية الدوائر المتكاملة.

Integrated circuits are one of the pillars of the technology industry in the world, as they are indispensable in devices, machines and equipment of various kinds, and with the availability of planning design components for integrated circuits, the owner is entitled to obtain a protection document known as a certificate of layout design for integrated circuits by the competent authority to grant this certificate in The country is the grantor of protection, and we have previously discussed the integrated circuits in a previous research, so we have devoted this research to addressing the conditions for the protection and registration of integrated circuits, and the legal implications of granting this protection to integrated circuits, represented in the rights and obligations of the design owner, with an indication of the exceptions established in this regard, and a review of the behavior of the legislator The Syrian and comparative legislations in granting this protection alike, using the descriptive and analytical approach based on opinions and judgments regarding the rules concerned with the protection of integrated circuits, and the use of the comparative approach in relation to the national legislation under study represented in Law 18 of 2012 which includes the principles of granting patents, their registration and publication, and emerging rights. It was found Through research the insufficiency of the rules regulating integrated circuits, whether in Syrian legislation, in addition to discussing these rules with what has been stipulated in the relevant international agreements and treaties, such as the Paris Agreement, the TRIPS Agreement and the Washington Agreement on Integrated Circuits. Especially for integrated circuits that are appropriate to their nature and the legislation in question is not satisfied with referring to the rules governing patenting and neglecting the copyright protection law and applying its rules in the exhibition of protection of integrated circuits.
