|b The quest for performance is a permanent concern of economic actors. This polysemous notion is originally a field of management sciences action. From now on, performance has been overtaken by the contractual practices of operators in business life. Based on this observation, this contribution proposes to highlight the different manifestations of performance within business contracts. For this purpose, we will analyze, after having delimited the traditional scope of obligations, the different techniques and practices of contracting performance.
|d La quête de la performance est une préoccupation permanente des acteurs économiques. Cette notion polysémique est d’origine un champ d’action des sciences de gestion. Désormais, la performance a été rattrapé par les pratiques contractuelles des opérateurs de la vie des affaires. Contenu de ce constat, cette contribution se propose de mettre en relief les différentes manifestations de la performance au sein des contrats d’affaires.
