يتلخص هذا المقال في محاولة الإحاطة بمقتضيات القانون 55.19 المتعلق بتبسيط المساطر والإجراءات الإدارية، على اعتبار أن هذا القانون نتاج مسار طويل من الإصلاحات بدأت معالمها تتجلى مع دستور 2011. وذلك من خلال الكشف على المبادئ والأسس التي يعتمد عليها هذا القانون بغيت التحقيق الفعلي لتبسيط الإجراءات الإدارية وتخفيف العبء على كاهل المواطن والإدارة في نفس الحين، حيث كما سنرى فإن نفض الغبار عن الإجراءات الإدارية سيجعل من مسار الحصول على القرار الإداري جد واضح بالنسبة للمرتفق ويخفف عليه من كثرة المساطر، وفي نفس الحين ستستفيد من ربح الزمن الإداري وتخفيف الضغط على الموارد البشرية، وذلك من خلال حذف المساطر غير الضرورية وغير المنصوص عليها قانونا. هذا علاوة على التطرق للتوجه الجديدة في تنظيم المساطر الإدارية بدءا بوضع طلب الحصول على قرار إداري إلى غاية الحصول عليه، مع كل ما يقتضي ذلك من معرفة للإدارة المسؤولة عن القرار، الوثائق المطلوبة، المدة اللازمة والمقابل المادي للقرار.
In this article summarized we will be trying to analysed the content of the law 55.19 related to the simplification of administrative procedures, considering that this law is the result of a long path of reforms, the features of which began to become evident with the 2011 constitution. We will do this by examining the principles and bases on which this law relies, with the aim of simplify administrative procedures and reducing the burden on citizens and administration at the same time. Whereas, as we shall see, reconsideration on the administrative procedures will make the process of obtaining the administrative decision very clear for the citizen with no large number of procedures, at the same time, administration will benefit from gaining administrative time, relieving pressure on human resources, by deleting unnecessary procedures that are not legally stipulated. In addition to addressing the new trend in organizing administrative procedures, starting with placing an application for obtaining an administrative decision until obtaining it, with all that is required in terms of knowledge of the administration responsible for decision, required documents, necessary period, and money cost.
