|a تتطرق هذه الورقة البحثية إلى موضوع حديث يتعلق بالتحديات الجديدة التي نتجت عن التحول الرقمي الذي عرفه الاقتصاد العالمي اليوم، في ظل النموذج الجديد الذي فرضته الثورة الرقمية الحديثة. وقد تناولت هذه الدراسة الإشكالات العملية والنظرية التي نتجت عن مواكبة المجتمعات العربية التحول الرقمي، ومدى مسايرة تشريعاتها الاقتصادية التحديات التي نتجت عنه، لاسيما في ظل جائحة كورونا. وقد أبرزت هذه الورقة أهمية التحول الرقمي ومظاهره، والتحديات التي نتجت عنه من جهة، ومدى مسايرة تشريعاتها المؤطرة للسوق، على غرار تشريعات المنافسة والتجارة الإلكترونية، فضلا على التشريعات الحمائية المتعلقة بحماية المعطيات الشخصية، من جهة ثانية. كما تركزت هذه الدراسة على حالتي دولتي الكويت والجزائر - كنموذج لذلك - وفق نظرة تحليلية واستقرائية، وكذلك نقدية؛ بهدف معرفة موضع الدول العربية، بما فيها الكويت والجزائر، من التحولات التي فرضتها الثورة الرقمية، ومدى استعدادها لمواكبة هذه التحولات، لاسيما من الناحية التشريعية. وقد خلصت هذه الدراسة إلى ضرورة تحقيق متطلبات التحول الرقمي، من خلال تهيئة البيئة الاقتصادية الرقمية، إلى جانب تكييف المنظومة القانونية المؤطرة للحياة الاقتصادية، لاسيما تشريعات المنافسة، والعمل على تشجيع المؤسسات الناشئة في المجال الرقمي، وترقية التجارة الإلكترونية، مقابل إقرار حماية قانونية فعالة للمعطيات الشخصية لمستخدمي الفضاء الرقمي، خصوصا المستهلك.
|b This research paper deals with a recent topic related to the new challenges resulting from the digital transformation that the global economy has known today, in light of the new model imposed by the modern digital revolution. This study dealt with the practical and theoretical problems that resulted from Arab societies coping with the digital transformation, and the extent to which their economic legislation coped with the challenges that resulted from it, especially in light of the Corona pandemic. This paper highlighted the importance of digital transformation and its manifestations, and the challenges that ensued from it, on the one hand, and the extent to which the legislation framing the market, such as competition and e- commerce legislation, as well as protective legislation related to the protection of personal data, are compatible with the market, on the other hand. This study also focused on the cases of the states of Kuwait and Algeria - as a model- within an analytical and inductive view, as well as a criticism aimed at knowing the position of the Arab countries, including Kuwait and Algeria, regarding the transformations caused by the digital revolution, and the extent of their readiness to keep pace with these transformations, especially from the legislative point of view. The study concluded by noting that it is necessary to achieve the requirements of digital transformation by creating a digital economic environment, in addition to adapting the needed legal system that frames economic life, especially competition legislation, working to encourage emerging enterprises in the digital field, and to promote electronic commerce, in return for establishing effective legal protection of the personal data of the users of the digital space, especially the consumer.
