|a تضطلع مفتشية العمل كجهاز رقابي بدور رئيسي في كفل تطبيق الأحكام التشريعية والتنظيمية المتعلقة بالصحة والأمن داخل المؤسسة المستخدمة وفقا لنص المادة 02 من القانون رقم 90-03 المعدل والمتمم والمتعلق بمفتشية العمل، لا سيما الدور الهام في الوقاية من المخاطر المهنية النفسية والاجتماعية التي تصيب العمال في أماكن العمل. وعلى ذلك منحها المشرع مجموعة من الآليات القانونية التي تمكنها من القيام بدورها الرقابي (كالقيام بالفحص والتحري والاطلاع على سجلات طب العمل) وكذا بدورها الوقائي بموجب القانون رقم 88-07 المتعلق بالوقاية الصحية والأمن وطب العمل. وهذا ما دعانا إلى التساؤل حول مدى فعالية جهاز مفتشية العمل في الرقابة على المخاطر النفسية والاجتماعية والوقاية منها في مجال العمل؟.
|b The Labour Inspectorate, as a supervisory body, plays a key role in enforcing the laws and regulations relating to health and safety in the employing establishment, in accordance with Article 2 of Act No. 90-03 as amended and completed relating to the labour inspection, in particular its important role in the prevention of psycho-sociological occupational risks affecting workers at the workplace. As a result, Parliament has assigned a number of legal mechanisms to the Commission to exercise its oversight role (including conducting reviews, investigating and reviewing occupational health records), and its preventive role under Act No 88-07 on the protection of occupational health, safety and medicine. This led us to question the effectiveness of labour inspection in the control and prevention of psycho-sociological risks and their prevention in the workplace.
|d L’Inspection du travail, en tant qu’organisme de contrôle, joue un rôle clé dans l’application des dispositions législatives et réglementaires relatives à la santé et à la sécurité dans l’établissement employeur conformément à l’article 2 de la loi no 90 -03 modifiée et complétée relative à l’inspection du travail, notamment son rôle important dans la prévention des risques professionnels psycho-sociologiques affectants les travailleurs sur le lieu de travail. Par conséquent, le législateur lui a affecté un certain nombre de mécanismes juridiques lui permettant d’exercer son rôle de contrôle (notamment, effectuer des examens, enquêter et examiner les dossiers de médecine du travail), ainsi que son rôle préventif en vertu de la loi no 88-07 sur la protection de la santé, de la sécurité et de la médecine du travail. Cela nous a amenés à nous interroger sur l’efficacité de l’inspection du travail dans le contrôle et la prévention des risques psycho-sociologiques et leur prévention en milieu de travail.
