المستخلص: إن التطورات العلمية السريعة التي يشهدها العالم وبالأخص في الآونة الأخيرة فرضت على المختصين ضرورة تجريب الدواء، لذا كان لزاما على المشرع الجزائري وعلى غرار بقية التشريعات المقارنة فرض جملة من الشروط على كل من القائم بتجريب الدواء والخاضع لتجربته، والتي يترتب على مخالفتها قيام المسؤولية الجزائية.

The rapid scientific developments that the world is witnessing, especially in recent times, imposed on the specialists the necessity of experimenting with the drug, so it was necessary for the Algerian legislator, similar to the rest of the comparative legislation, to impose a number of conditions on both the one who experimented with the drug and the one subject to his experiment, and whose violation entails the establishment of criminal liability

Les développements scientifiques rapides auxquels le monde assiste, surtout ces derniers temps, ont imposé aux spécialistes la nécessité d'expérimenter le médicament, il a donc fallu que le législateur algérien, à l'instar du reste de la législation comparée, impose un certain nombre de conditions tant à celui qui a expérimenté la drogue qu'à celui qui y est soumis, et dont la violation entraîne l'établissement de la responsabilité pénale.
