|a تهدف هذه الدراسة إلى تسليط الضوء على أحكام الرجوع في الهبة والذي يعتبر من الموضوعات الشيقة التي تثير الكثير من الجدل في المجال الفقهي والقانوني معا، ونظرا لكون التبرع أخطر ما في التصرفات المالية باعتبار أنه تطوعا من غير شرط أو عوض، وجب على الواهب التروي والإحاطة بآثار ما سيقدم عليه من تصرف، لذا يتعين عليه تبصره بمدى إمكانية رجوعه عن هذه الهبة، وتحقيقا لجوهر ومقصد تبرعه. وإن أهم ما يبرز أهمية الموضوع فظلا عن خطورة التصرف ذاته الأمر الذي يطرح مدى جواز الرجوع في الهبة؟ وماهي طبيعة ذلك الرجوع وما هو تأثيرها؟

What is the nature of that return and what is its impact?
|d Cette étude vise à faire la lumière sur les dispositions du retour du don, qui est considéré comme l'un des sujets intéressants qui soulèvent beaucoup de controverses dans les domaines jurisprudentiel et juridique réunis.Ce qu'il va faire en termes de comportement, il doit donc être conscient de la mesure dans laquelle il peut se retirer de ce don, et afin d'atteindre l'essence et le but de son don. Et la chose la plus importante qui souligne l'importance du sujet, en plus de la gravité du comportement lui-même, est la question qui soulève la licéité du retour du cadeau ? Quelle est la nature de ce retour et quel est son impact?
