المستخلص: ناقش البحث موضوع الدراسة ضوابط تجديد الفكر الإسلامي بين الأصالة والمعاصرة؛ أهم قضايا التجديد في الفكر الإسلامي، ولقد تضمنت الدراسة البحثية كشف اللثام عن مفاهيم التجديد، ومفاهيم الفكر، كما تضمنت الدراسة أهم موضوعات وتقاسيم الفكر الإسلامي والتي منها الفكر العقدي، والفكر المقاصدي، والأصولي، وتطرقت الدراسة للحديث عن التجديد في الفقه الإسلامي؛ لاسيما مع مراعاة عدة أمور تتلخص في الآتي: أولاً: فقه الواقع ثانياً: المصلحة، والمصلحة المرسلة، وما يترتب على الأحكام الفقهية من تغيير عند مراعاة المصالح. ثالثاً: السياسة العالمية، وما يتعلق بها من أمور؛ كمراعاة حال الأقليات المسلمة وما يعتري واقعهم من فقه، وأحكام شرعية، ولم يغفل الباحث في الدراسة مسألة تجديد التراث الإسلامي؛ لا سيما مع ما استحدث من نظريات تتعلق بالحديث عن تجديد التراث، ثم جاءت النتائج وهي كالآتي: أولاً: أن ضوابط التجديد في الفكر الإسلامي بين الأصالة والمعاصرة تعددت بتعدد مكونات الفكر الإسلامي، فهناك ضوابط تجديد العقيدة، وضوابط تجديد الفقه الإسلامي، وضوابط تجديد علم أصول الفقه، وضوابط تجديد الفكر المقاصدي. ثانياً: أهمية الواقع، وتفعيل فقه الواقع، ومراعاة مصالح العباد. ثالثاً: الاتفاق على المرجعية الإسلامية، وإحياء الاجتهاد الجماعي من أبرز ضوابط التجديد في الفكر الإسلامي بين الأصالة والمعاصرة. رابعاً: النظر في حال الأقليات، وظروف معيشتهم، وواقع حياتهم، يكون فكرة مستنيرة عند علماء الفتوى، ويستطيع المجتهدون من خلالها إصدار فتاوى تتماشى مع صحيح الدين وواقع الأقليات.

The research discussed the subject of the study the controls of renewal of Islamic thought between originality and modernity. The most important issues of renewal in Islamic thought, and the research study included revealing the concepts of renewal and concepts of thought. Especially, taking into account several things that are summarized as follows: First: The controls for renewal in Islamic thought between authenticity and modernity are numerous with the multiplicity of components of Islamic thought. Second: The importance of reality, activating the jurisprudence of reality, and taking into account the interests of people. Third: Agreement on the Islamic reference, and the revival of collective ijtihad is one of the most prominent controls for renewal in Islamic thought between authenticity and modernity. Fourth: Looking at the condition of minorities, their living conditions, and the reality of their lives, constitutes an enlightened idea for fatwa scholars, and mujtahids can issue fatwas that are in line with the true religion and the reality of minorities. In the study, the researcher did not neglect the issue of renewing the Islamic heritage; Especially with the theories that were developed related to the talk about the renewal of heritage. Then the results came, which are as follows: First: The controls for renewal in Islamic thought between authenticity and modernity are numerous with the multiplicity of components of Islamic thought. Second: The importance of reality, activating the jurisprudence of reality, and taking into account the interests of people. Third: Agreement on the Islamic reference, and the revival of collective ijtihad is one of the most prominent controls for renewal in Islamic thought between authenticity and modernity. Fourth: Looking at the condition of minorities, their living conditions, and the reality of their lives, constitutes an enlightened idea for fatwa scholars, and mujtahids can issue fatwas that are in line with the true religion and the reality of minorities.
