تعد الثقة والأمان عنصران أساسيان يجب توافرهما في المعاملات الإلكترونية، وتحقيق ذلك يتطلب تدخل طرف ثالث موثوق محايد يعرف بمؤدي خدمات التصديق الإلكتروني، مهمته تصديق المعلومات والبيانات المتبادلة عبر شبكة الإنترنت، مما يؤدي إلى التوثق من صدورها ممن نسبت إليه دون تحريف أو تبديل، ونجاحه في ذلك مرهون بقيامه بالواجبات المفروضة عليه قانونا، والتي يترتب على مخالفتها قيام مسؤوليته. غير أن كثرة وتنامي المعاملات الإلكترونية، وظهور خدمات جديدة عبر الشبكة، جعل من الضمانات الحالية غير كافية لمجابهة الخدمات الإلكترونية الحديثة، مما يتطلب تدخل المشرع الجزائري بتنظيم هذه الخدمات ضمن نصوص قانونية، مع تحديد وضبط التزامات ومسؤولية جهة التصديق بما يتلاءم ومستويات هذه الخدمات. Trust and security are essential elements that must be available in electronic transactions, and achieving this requires the intervention of a third party known as the provider of electronic certification services ,whose task is to certify the data exchanged over the internet ,which leads to authentification of its issuance from the NSBT to it without distortion oral alternative. His success in doing so depends on the performance of the duties imposed on him by law , the violation of which entails his responsibility. However ,the large number and growth of electronic transactions ,and the emergence of new services on the network ,made the current guarantees insufficient to confront modern electronic services , which requires the intervention of the Algerian legislator to organize these services within legal texts ,while determining and controlling the obligations and responsibilities of the certification body in accordance with and the levels of these services. La confiance et la sécurité sont des éléments essentiels qui doivent être disponibles dans les transactions électroniques, et y parvenir nécessite l'intervention d'un tiers connu comme le fournisseur de services de certification électronique, dont la tâche est de certifier les données échangées sur Internet, ce qui conduit à l'authentification de son émission auprès du NSBT s'y oppose sans distorsion orale. Son succès dépend de l'exécution des devoirs qui lui sont imposés par la loi, dont la violation engage sa responsabilité. Cependant, le grand nombre et la croissance des transactions électroniques, et l'émergence de nouveaux services sur le réseau, ont rendu les garanties actuelles insuffisantes pour faire face aux services électroniques modernes, ce qui nécessite l'intervention du législateur algérien pour organiser ces services dans les textes légaux, tout en déterminant et contrôler les obligations et les responsabilités de l'organisme de certification conformément à et aux niveaux de ces services. |
