|a الفساد هو أحد آفات العصر، ولاتنحصر تلك الآفة في ثقافة أو بلد ما، فهي ظاهرة متواجدة في كل العالم، كما هي موجودة في القطاعين العام والخاص، وفي مختلف طبقات المجتمع، لكن تأثيرها السلبي يكون أشد على الدول التي تسعى جاهدة لتحسين التنمية الاقتصادية والاجتماعية، للفساد والانحراف الإداري والمالي صور عديدة يأتي في مقدمتها الغدر والإختلاس وتبديد المال العام، واستغلال النفوذ، والرشوة التي تشهدها المؤسسات والهيئات. يترتب على الموظف واجبات والتزامات منها المرتبط بالوظيفة ومنها ما لا يرتبط بها، وتتحدد هذه الواجبات والالتزامات في النصوص القانونية الأساسية العامة للوظيفة العمومية، وإذا كان عمل الشخص عارضا أو موسميا، أو للقيام بمهمة معينة، لا يعتبر موظفا عمومياً، ويترتب على الموظف واجبات والتزامات، وكل إخلال بها سوف يعرض صاحبها إلى عقوبة تأديبية وقد تكون إلى جانبها عقوبة جنائية، وقد حرصت التشريعات الجنائية على تقرير نظام عقابي خاص لمواجهة جرائم الفساد، حيث يقتضي الإطار التشريعي لجرائم الفساد ومعاقبة مرتبكيه وجود نظام إجرائي فعال ومتكامل لملاحقة المتهمين ومحاكمتهم واسترداد عوائد نشاطهم الإجرامي. وأصبح تطور السلطة الإدارية من المظاهر الحديثة لمواجهة تحديات العصر الحديث والحد من جرائم الفساد المالي والإدري والتأثيرات السلبية على الأفراد والبيئة والممتلكات.

The employee has duties and obligations, some of which are related to the job and some that are not related to it, and these duties and obligations are determined in the general basic legal texts of the public office, and if the person’s work is casual or seasonal, or to carry out a specific task, he is not considered a public employee, and the employee has duties and obligations, Any breach of it will expose its perpetrator to a disciplinary penalty and may be accompanied by a criminal penalty. Criminal legislation has been keen to establish a special punitive system to confront corruption crimes, as the legislative framework for corruption crimes and the punishment of the perpetrators requires the existence of an effective and integrated procedural system to prosecute and prosecute the accused and recover the proceeds of their criminal activity. The development of the administrative authority has become one of the modern manifestations to meet the challenges of the modern era and reduce the crimes of financial and administrative corruption and the negative effects on individuals, the environment and property.
