المستخلص: لقد أدى تزايد العنف الزوجي في الجزائر وخطورته على الأسرة والمجتمع إلى تحرك المشرع نحو تعزيز الحماية الجزائية للزوجة ضد التعنيف الجسدي والنفسي والمالي الذي تتعرض له من زوجها، حيث جاء القانون 15-19 بتعديلات هامة بهذا الخصوص متناسيا تجريم العنف الجنسي ولإبراز أهمية الموضوع تناولت خصوصية ومظاهر هذه الحماية، من خلال عرض المميزات السياسة العقابية والتجريمية التي أقرها المشرع للزوجة ضد أشكال العنف الزوجي.

This article discusses the quarrel over the philosophy of history in the Enlightenment, between the French philosophers on the one hand and the German philosopher Johann Gutfrig Herder on the other, and also focuses on Herder’s criticism of the foundations of the philosophy of history according to the French enlightenment philosophers, and how this criticism led to the founding of the idea of cultural pluralism and values. Herder realized that a true and objective understanding of history and its components could not be achieved by applying the principles of enlightenment rationalism. This is why he proposed to understand each culture and each historical period according to its own specific values.

Cet article aborde la querelle sur la philosophie de l’histoire au Siècle des Lumières, entre les philosophes français d’une part et le philosophe allemand Johann Gutfrig Herder d’autre part, et focalise aussi sur la critique herderienne des fondements de la philosophie de l’histoire selon les philosophes des lumières français, et comment a conduit cette critique à fonder l’idée d’un pluralisme culturel et des valeurs. Herder s’est rendu compte qu’une compréhension véritable et objective de l’histoire et de ses composantes ne pouvait être réalisée en appliquant les principes de rationalisme des lumières. C’est pourquoi il a proposé d’appréhender chaque culture et chaque période historique selon ses propres valeurs spécifiques.
