|a يعتبر إبرام الصفقة العمومية عملية قانونية تنعقد وفق قواعد التنافس الحر وتتميز بتعدد واختلاف الطرق المعتمدة لاختيار المتعاقد مع المشتري العمومي، والمبدأ هو أن الإدارة حرة في اختيارها لطريقة التعاقد ما لم يفرض عليها القانون طريقة معينة. والطريقة الاعتيادية لإبرام الصفقات العمومية هي طلب عروض، خاصة بعد إلغاء المناقصة. وفي إطار هذا السياق يتنزل موضوع طلب العروض لإجراء عام تقوم من خلاله الإدارة بإخضاع عملية التعاقد لأكبر قدر من المنافسة مع المحافظة على حريتها في إسناد الصفقة.

The usual method of concluding public procurement is to request bids, especially after canceling the tender. In this context, the subject of the request for proposals comes down to a general procedure through which the administration subject the contracting process to the greatest degree of competition while preserving its freedom to award the deal.
