المستخلص: للقضاء طرق يعتمد عليها القضاة في أحكامهم، ويعول عليها القاضي في تنفيذ الأحكام فهي جزء من القضاء، والطريقة المثلى في تحقيق العدل، وقد أولت الشريعة الإسلامية طرق الحكم عناية كبيرة لأن طرق الحكم تقطع بها الخصومات، وترد الحقوق إلى أصحابها، ومن هذه الطرق القرعة، فقد عمل بها نبينا محمد صلى الله عليه وسلم حيث طبقها فعلا بين نسائه، وأمر بها، وتبعه الصحابة الكرام، وقضوا بها بين الناس، وتبعهم على العمل بها، وتوضيح طرقها، وبسط مسائلها الفقهاء في كتب الفقه، ولا يكاد يخلو كتاب من كتب الفقه من باب القرعة. فقد ركز البحث المعنون بـ"الشروط المتعلقة بالقرعة القضائية" على مقدمة، وتمهيد، ومبحثين، وخاتمة، وفهارس. أما المقدمة: ففيها الافتتاحية، وأسباب اختيار الموضوع، والدراسات السابقة، وخطة البحث، ومنهج البحث. أما التمهيد: ففيه التعريف بمفردات عنوان البحث، كتعريف الشرط، والقرعة، والقضاء لغة، واصطلاحا. وأما المبحث الأول: ففيه الحكم الشرعي للقرعة، وما يجري فيه القرعة، وما لا يجري فيه. وأما المبحث الثاني: يتضمن بشروط القرعة القضائية، كشرط تساوي الحقوق، وشرط وجود التنازع، وشرط وجود اشتباه الأمر. أما الخاتمة: ففيها نتائج البحث. والفهارس: ففيها المصادر، وفهرس الموضوعات.

The judiciary has methods that judges depend on in their rulings; a judge relies on them in executing rulings, as they are part of the judiciary, and the best way to achieve justice. Islamic law has paid a big attention to the methods of rulings, because by these methods disputes are settled and rights made to be returned to their owners. Lottery is one of them. Prophet Muhammad, acted upon it, as he actually implemented it among his wives, enjoined it, and the honorable companions followed him, ruled by it among the people, the jurists followed them to act upon it, clarified its methods, and expanded its issues in the books of jurisprudence. The research entitled "Conditions Related to the Judicial Lottery" focused on an introduction, a preface, two chapters, a conclusion, and indexes. The Introduction contains the preface, the reasons for choosing the topic, the previous studies, the research plan, and the research methodology. Preface defines the vocabulary of the research title, such as defining the condition, the lottery, and the judiciary linguistically and idiomatically. The first topic contains the legal ruling of the lottery, and in what the lottery takes place, and in what it does not take place. The second topic includes the conditions of the judicial lottery, such as the condition of equal rights, the condition of the existence of conflict, and the condition of the presence of suspicion in the matter. The conclusion contains the results of the research. And indexes: it contains the sources, and the index of subjects.
