|a إن من أقسام الحقوق التي قسمها الله تعالى قسمان هما: حقوق الله وحقوق الناس، وإن معرفتهما ومعرفة الأعمال الخاصة بكل منهما يساعدنا على التعرف على الأعمال الخاصة لكل حالة من الحالات التي تحتوي على أمثلة متداخلة في كلا الفئتين وفهم ترتيبها، وعلى الرغم من وجود اختلافات كثيرة بين هاتين الفئتين في الأعمال المكتوبة لفقهاء عظام، إلا أنه لم يتم إجراء الكثير من الأبحاث حول هذا الموضوع. ولهذا السبب، تم اختيار هذا المقال، وطرحه بطريقة وصفية وتحليلية، وهي جزء من البحث النوعي، بشكل موثق، من خلال الدراسة والتأمل في الفقه والنصوص المتعلقة به، مع بيان أهم جوانب الفرق بين حق لله والدين، وحقوق الناس والأحكام الناتجة عن انفصالهم، ومن النتائج التي توصلنا اليها: يقوم حق الله على ما يلي: الاستخفاف والتسامح وعدم قبول شهادة المرأة وحدها، والشهادة بالشهادة، وعدم التوقف عن الطلب في بداية التحقيق وتنفيذ الحكم الصادر، وضرورة اعترافان على الأقل لإثبات الحق وجواز منع الاعتراف، وعدم إجهاض المستفيد، وإمكانية الحكم بناء على علم القاضي، ومنع الإجراءات الغيابية، والتنازل بالتوبة قبل الإثبات أمام الحاكم، جواز الإدلاء بالشهادة، عفو القاضي عن المجرم، تحريم العقوبة عندما يصبح الشاهد غير أخلاقي بعد الإدلاء بشهادته، بينما في حق الناس هذه الميزات معاكسة أو غير موجودة.
|b One of the divisions of rights is its division into God’s right of and people’s right, and knowing each of them and the special effects of each of them helps us identify and arrange the specific effects of each in cases where both categories of rights apply and disagree; Although several differences between these two establishments have been expressed in a scattered manner in the written works of great jurists, little has been investigated independently in this regard. Therefore, the most important aspects of differentiation of the God’s rights and people’s rights and the regulations on separating the two issues are expressed in the present paper with a descriptive and analytical method, which is among the qualitative researches, in the literature review manner, by studying and considering the jurisprudential texts as well as related texts. The findings are: God's rights are based on mitigation and tolerance, refusal to accept the testimony of individual women and testimony on testimony, not stopping on the demand at the beginning of the trial and the verdict implementation, the necessity for at least two confessions to prove the right and permission to prevent the confession, non-dismissal by the interested party, possibility of judgement based on the judge's knowledge, prohibition of absentee proceedings, dismissal with repentance before proving to the ruler, acceptability of donation in testimony expression, offender forgiveness by the judge, sentence prohibition by the witnesses’ perversion after the testimony, while these characteristics either do not exist or are vice versa in people’s right.
