|a نظراً إلى أبحاث العلماء في مسألة بيع الفضولي، وما يتعلق بها من أحكام فقهية فكان تناولهم للمسألة من جهة، الجواز وعدمه، وتصرف الفضولي في الإجازة صحيحة غير صحيحة وحجية الإجازة هل هي كاشفه أو ناقله، وأشكال تصرف الفضولي، وضمان تصرف الفضولي في المثلي والقيمي. فتكون دراستنا لموضوع الفضولي انه لا يخرج عن تقسيم هيكلة الفقهاء، إنما نبحث أثر تصرف الفضولي بشكل عام بين المالك الشرعي وبين تصرف الفضولي، وبين الطرف الأخر، وعرض آراء فقهاء المسلمين في تصرف الفضولي بالعقد واختلافهم فيه، فهل تصرفه يجري ضمن إنشاء يسمى عقد الفضولي أو لا اعتبار لهذا الإنشاء كونه فضولي، وإنشائه العقد متوقف على إجازة المالك الشرعي فنحقق البحث في بيان تعريفات معنى العقد، والفضولي نفسه وأشكال التصرفات وأثارها في عقد الفضولي.
|b In view of the scholars’ research on the issue of selling al-Fuduli, and the related jurisprudential rulings, their approach to the issue on the one hand was the permissibility and its absence, and the al-Fuduli’s behavior in the authorization is correct and incorrect, the authoritativeness of the authorization is it a revealer or a transmitter, and the forms of the conduct of the curious, and the guarantee of the conduct of the curious in the ideal and value. So, our study of the subject of the curious is that it does not depart from the division of the structuring of the jurists, but we are looking at the effect of the behavior of the curious in general between the legitimate owner and the behavior of the curious, and between the other party, and the views of Muslim jurists on the curious behavior of the contract and their differences in it, so does his behavior take place within a structure called the curious contract or There is no consideration for this creation as being curious, and its creation of the contract depends on the permission of the legal owner, so we investigate the research in clarifying the definitions of the meaning of the contract, and the vassal himself and the forms of behaviors and their effects in the curious contract.
