|a العقد الإلكتروني يتم إبرامه دون حاجة إلى التواجد المادي للأطراف أي عدم وجود مجلس للعقد حقيقي بل افتراضي فقط، فهو بذلك يندرج ضمن طائفة العقود المبرمة عن بعد، حيث يتم تبادل الإيجاب والقبول عبر شبكة الإنترنت لذلك فهو فوري ومعاصر. والعقد الإلكتروني تعتمده التجارة الإلكترونية كأساس لها ويرتبطان ارتباطا وثيقا، إلا أن وجه الاختلاف بينهما يكمن في الوسيلة التي ينعقد بها كل واحد منهما، فالعقد الإلكتروني يستوجب الطريقة الإلكترونية عبر شبكة دولية مفتوحة للاتصال عن بعد.
|b The electronic contract is concluded without the need for the physical presence of the parties, i.e. there is no real council for the contract, but only virtual. Thus, it falls within the category of contracts concluded remotely, where the offer and acceptance are exchanged via the Internet, so it is immediate and contemporary. The electronic contract is adopted by electronic commerce as its basis and they are closely related, but the difference between them lies in the method by which each one of them is concluded. The electronic contract requires the electronic method through an open international network for remote communication.
