|a يهدف البحث إلى بيان مشروعية وسائل التغيير السلمي لنظام الحكم من منطلقات السياسة الشرعية مع بيان التكييف الشرعي لهذه الوسائل ضمن قواعد وكليات السياسة الشرعية، بحيث يحفظ للناس حقوقهم وتبين لهم واجباتهم، وذلك من خلال ربط وسائل التغيير بمقاصدها وبيان خصائصها مع بيان مراتب التغيير وأنواعه، وتحديد ملامح مرحلة التغيير السلمي وتمييزها عن مراحل التغيير المختلفة ومنها مرحلة التغيير غير السلمي، ولرد الفروع إلى الأصول تم وضع مجموعة من الضوابط التي تنظم العمل بوسائل تغيير المنكر بصورة سلمية حضارية؛ لضمان تحقيق مراد الشارع الآمر بتغيير المنكر، والتأكد من تحقيق مصالح الناس المطالبين بالتغيير، وقد خلص البحث إلى نتائج عدة منها: أن التغيير السلمي حق مشروع للناس وفق التصور الإسلامي لطبيعة نظام الحكم المدني من حيث أفراده والديني من حيث أصوله وتشريعاته، وأن التغيير السلمي من حيث الخصائص والوسائل والضوابط يفترق تماماً عن التغيير غير السلمي، ومن أهم التوصيات: مراعاة هذا الحق في عمليات الاجتهاد والفتوى خصوصاً في الفقه العام تجاه الحكام والمحكومين على حد سواء.
|b This research aims to establish the legitimacy of the means of peaceful change of state regime based on political and Sharia focused premises. It explains the ways in which the sharia adapts and accommodates these means with the universals and maxims of Sharia focused policy so that people’s rights are preserved and their obligations and clarified through connecting these means of change with their higher objectives and characteristics. It explains the stages and areas of change, determines the features of peaceful change, and distinguishes them from other stages of change and non-peaceful change. It connects the derivative cases (furūᶜ) with their principles (uṣūl), and founds regulations that organize the application of the means of changing harm in a peaceful and civil manner to guarantee the fulfillment of the objective of the lawgiver and ensuring the realization of the benefits of the people who require change. This research arrived are several conclusions. Peaceful change is a right of the people, and it should be coined from within the Islamic conception of the nature of civil state rule with resect to its individuals and religious rule with respect to its fundamentals and laws. Also, peaceful change, in regard its characteristics, means and regulations, is different from non-peaceful change. One of the main recommendations, therefore, is to keep into account this right in conducting ijtihad and issuing fatwa in the general field of fiqh toward rulers and subjects alike.
