|a سعت هذه الدراسة إلى بيان أثر التخريج الفقهي في حجية وسائل الإثبات بالمقاييس الحيوية في جسم الإنسان، فاعتمدت المنهج الاستقرائي بجمع المقاييس الحيوية في جسم الإنسان، وعرفت بها تعريفا مختصرا، ثم بينت مدى حجيتها باعتماد المنهج الاستدلالي، وأثر التخريج الفقهي عليها، وخلصت إلى اعتبارها قرينة معتبرة من قرائن الإثبات التي يأخذ بها القضاة الشرعيون وغيرهم لإثبات حق أو نفيه حسب ضوابط ناظمة لها؛ وهي بذلك تسهم في بيان الحكم الشرعي للمقاييس الحيوية في وسائل الإثبات ومشروعية العمل بها وفق أقوال الأئمة وقواعدهم الفقهية التي استندوا إليها.
|b This study aimed to clarify the effectiveness of jurisprudential authentication in the validity of proof means of human biometrics, so the inductive approach was used by collecting the human body’s biometrics, and it was given a brief definition, then it’s pointed out its authentication by adopted the deductive approach, and the effectiveness of jurisprudential authentication. The study found that it is a considered evidence form the evidence of proof that adopted by Sharia judges to prove or defense a right according to the controls governing it; it therefore contribute to indicate the Islamic ruling on biometrics in the means of proof and the legitimacy to apply them according to the opinions of the imams and their rules of Jurisprudence on which they based.
