المستخلص: إن التغيرات الاقتصادية، والسياسية والاجتماعية التي طالت شعوبا ودولا كثيرة؛ أدت إلى انتقال مجموعات كبيرة من الناس للعيش في مجتمعات تختلف دينيا وثقافيا عن مجتمعاتها الأصلية، مما خلق عند الطرفين (المهاجرين والمهاجرين إليهم) شعورا بالخوف، والاضطراب، والقلق على هويتهم الدينية والثقافية من أن تتأثر بثقافة ودين الطرف الآخر، وسبب لهم هذا الخوف إشكالا كبيرا في التأقلم، فالإنسان الغربي ينظر إلى الإنسان المسلم في ديار الغرب بكثير من الشك والريبة، والحذر بسبب الصورة المشوهة التي سوقها الإعلام الغربي عن الإسلام وأتباعه، والتي تختصر في أن الإسلام دين عنف واستبداد وتخلف، وأتباعه إرهابيون متشددون، كما نجد أن معظم المهاجرين لا يعلم حدود انخراطه في المجتمع الجديد، فإما يعزل نفسه عن هذا المجتمع كي يحافظ على هويته الدينية والثقافية، أو ينصهر فيه ويذوب بدعوى الاندماج، وقليل منهم من يتبع الخيار الذي يقدمه الإسلام والمتمثل في التعايش مع الآخر والتعاون معه على تحقيق المصالح المشتركة التي تضمن للجميع العيش بسلام دون التصادم معه أو الذوبان فيه. وإننا في هذا البحث نروم إلى استنباط الضوابط الشرعية التي يقوم عليها التعايش السلمي للمسلمين في الغرب، وكذلك المقتضيات الحضارية التي تفرض على المسلم وغير المسلم الجنوح إلى خيار التعايش السلمي، كما يسعى البحث لتسليط الضوء على التحديات الراهنة التي تقف عقبة في وجه تحقيق هذا التعايش. وقد اعتمدنا فيه على المنهج التحليلي.

The economic, political and social changes that have affected many peoples and countries have led to the immigration of large groups of people to live in societies that differ religiously and culturally from their indigenous communities. This has created a sense of fear, confusion and concern for their religious and cultural identity to be influenced by the culture and the religion of others and caused them a great problem in the adaptation and interaction with each other. The Western man views the Muslim man in the West with much suspicion and caution because of the distorted image that Western media has of Islam and its followers, which abridges Islam to a religion of violence, tyranny and backwardness, and depicts its followers as radical terrorists. We also find that most migrants do not know the limits of their involvement in the new society and their interactions with it. Thus, the immigrant either isolates himself and his family from this society in order to maintain his religious and cultural identity or melts in it and dissolves on the pretext of integration. But only a few of them follow the option offered by Islam, which is the coexistence with the other and the cooperation with him/ her to achieve common interests that ensure peaceful life for everyone without crashing or melting. In this research, we aim to devise the legal controls upon which the peaceful coexistence of Muslims in the West is based, as well as the civilization requirements that impose on Muslims and non-Muslims the devotion to the option of peaceful coexistence, as the research seeks to shed light on the current challenges that stand in the way of achieving this coexistence. We have relied on the inductive analytical deductive approach.
