المستخلص: يتلخص البحث في ذكر المسائل المعاصرة في البيع والتي انفرد بها الحنابلة، وهي تدل على فقه الإمام أحمد وتميزه في اجتهاده، وتظهر مفرادات المذهب العلمية باعتبارها عند المقارنة، وأهمية هذه الآراء في التيسير على الناس ورفع الحرج عنهم في بعض القضايا، حيث اشتمل البحث على التورق المصرفي وأثره على المعاملات البنكية، وبيع الذهب القديم بالذهب الجديد وأثره على صحة العقد، والخيار في عقد الصرف في الفقه الحنبلي وأثره على صحة العقد، وبيع المرابحة للأمر بالشراء، وبيع العربون في المرابحة للأمر بالشراء، وتتلخص إشكالية البحث في إظهار المسائل التي انفرد بها الحنابلة في كتاب البيع وما واقع تطبيق تلك الانفرادات على المعاملات المالية المعاصرة في البيع والآثار الفقهية الناتجة عن تطبيق انفرادات المذهب الحنبلي على المعاملات المالية المعاصرة في البيع، مع ذكر أقوال المذاهب الفقهية الأخرى في المسألة، وذكر أدلتهم ومقارنتها ثم ذكر رأي الباحث في المسألة، وقد سار البحث على المنهج الاستقرائي والمنهج التحليلي المقارن والمنهج الوصفي، وأما خطة البحث فتتكون من مقدمة وأربع مباحث وهي: التورق المصرفي وأثره على المعاملات البنكية، وبيع الذهب القديم بالذهب الجديد وأثره على صحة العقد، والخيار في عقد الصرف في الفقه الحنبلي وأثره على صحة العقد، وبيع المرابحة للآمر بالشراء. ومن أهم نتائج البحث الجانب التطبيقي المفردات الحنابلة التي تدل على قوة فقه الحنابلة وتميزه عن غيره من المذاهب الفقهية، والتي تبين عدم تشدده كما يصفه بعض الناس، وأن مذهب الحنابلة انفرد بمسائل في المعاملات دون غيره من بقية المذاهب كمسألة التورق فلم يرد مصطلح "التورق" بلفظه إلا في كتب فقهاء الحنابلة، وأن كراهة بيع المرابحة من مفردات الحنابلة.

The research is summarized in mentioning the contemporary issues in selling, which are unique to the Hanbalis, and they indicate the jurisprudence of Imam Ahmed and his distinction in his diligence, and the uniqueness of the scientific doctrine appears when compared, and the importance of these opinions in facilitating people and lifting their embarrassment in some cases, as the research included tawarruq Banking and its impact on banking transactions, selling old gold with new gold and its impact on the validity of the contract, the option in the exchange contract in Hanbali jurisprudence and its impact on the validity of the contract, the sale of Murabaha to the orderer to buy, and the sale of the down payment in the Murabaha to the orderer to buy, and the problem of the research is summarized In showing the issues that are unique to the Hanbalis in the Book of Transactions and what is the reality of the application of those singularities On contemporary financial transactions in selling and the jurisprudential effects resulting from the application of the uniqueness of the Hanbali school of thought on contemporary financial transactions in selling, with mentioning the sayings of other jurisprudential schools in the matter, and mentioning their evidence and comparing them, then mentioning the researcher's opinion on the issue. Descriptive, and as for the research plan, it consists of an introduction and four topics to,bank securitization and their impact on banking transactions, THE sale of old gold in new gold has an impact on the validity of the contract,THE option in the exchange contract in Hanbali jurisprudence and its effect on the validity of contract, Sell Murabaha for purchase order. Among the most important results of the research is the applied aspect of the Hanbali vocabulary, which indicates the strength of the Hanbali jurisprudence and distinguishes it from other jurisprudential schools of thought, which shows that it is not strict as some people describe it, and that the Hanbali school of thought is unique in matters of transactions without other schools such as the issue of tawarruq. Its wording is only in the books of the Hanbali jurists, and that the dislike of murabaha selling is one of the Hanbali vocabulary.
