المستخلص: تناول هذا البحث دراسة نوع مهم من أنواع القياس الأصولي، وهو قياس الشبه الذي يكثر التعويل عليه في مختلف مجالات الفقه الإسلامي، وركز على بيان حقيقته، وخلاف العلماء في حجيته، وشروط العمل به، وبيان الفرق بينه وبين قياس العلة، وقياس الدلالة، وقياس غلبة الأشباه؛ ولأجل تحقيق ذلك، فقد تهيكل البحث على أربعة مباحث، أولها: في بيان حقيقة الشبه وأنواعه، والثاني: في الكشف عن حقيقة الاختلاف الواقع في حجيته، والثالث: في إبراز شروطه عند القائلين به وأهميته، والرابع: في سرد بعض الفروع الفقهية التي كان لقياس الشبه أثر في اختلاف الفقهاء بشأنها، وكان الاعتماد على المنهج الاستقرائي الذي يقوم على استقراء ما أورده علماء الأصول من تعريفات وحدود للشبه وأنواعه، ثم على المنهج التحليلي الذي يقوم على تحليل ما تم جمعه وسبر أغواره، وتوصل البحث إلى جملة من النتائج؛ أبرزها: إن قياس الشبه من أدق أنواع القياس حتى قبيل بعدم حده؛ وأن غالب ما يورده الفقهاء من أقيسة إنما هو من هذا الباب؛ مما يشي باتفاق عملي على الأخذ به، خلافاً لما يذكر في التأصيل.

This research deals with the study of an important type of jurisprudential analogy, which is the analogy analogy that is frequently relied upon in the various fields of Islamic jurisprudence and focuses on clarifying its truth and the disagreement of scholars regarding its validity, the conditions for working with it, and explaining the difference between it and the analogy of the cause, the analogy of the significance, and the analogy of the predominance of the analogy. make it happen; The research was structured on three topics. The first: in explaining the reality of similarity and its types, the second: in revealing the truth about the difference in its authenticity, and the third: in highlighting its conditions for those who say it and its importance; The reliance was on the inductive approach, which is based on the extrapolation of the definitions and limits of the similarity and its types provided by scholars of origins, and then on the analytical approach, which is based on analyzing and exploring what has been collected, and the research reached a number of results; Most notably: The analogy of similarity is one of the most accurate types of analogy, until it was said that there is no limit to it. And that the majority of what the jurists mention in terms of measurements is from this section; Which indicates a practical agreement to adopt it, contrary to what is mentioned in rooting and theorizing.
