المستخلص: للنشوز في اللغة معان عدة منها الارتفاع والعلو، ونشز ينشر نشوزا، وأشرف على نشز من الأرض، أي ما ظهر وارتفع (). وقد استعير هذا المعنى الحسي للدلالة على ترفع الزوجة واستعلائها على طاعة الزوج، أما في الاصطلاح الغالب فيعني خروج الزوجة عن طاعة زوجها (). والمعنيان أعلاه يربطان النشوز بالزوجة فقط بوصفها صفة لصيقة بها من دون الزوج في إطار العلاقة الزوجية كما في نطاق القانون، إلا أن النشوز كما يكون من الزوجة يكون من الزوج وإن أطلق لفظ النشوز في حق الزوجة من دون الزوج باعتبار أن عقد الزواج من العقود التي ترتب التزامات وحقوق متقابلة على طرفي العقد، ومن ثم فإن عدم التزام أحد الطرفين بأداء حقوق الطرف الآخر وترفعه وعلوه عن القيام بواجباته يجعل من اللازم عده ناشزا سواء اقترنت هذه الصفة بالزوجة من دون الزوج أو بالزوج من دون الزوجة أو بكليهما على حد سواء، وهذا القول يدفع إلى البحث عن نشوز الزوج في نطاق القانون بوصفه مصطلحا مغيبا في النص القانوني بل الفقه القانوني غالبا، من دون الولوج في بحث نشوز الزوجة بوصفه مصطلحا معروفا وواضحا في نطاق التشريع والفقه القانونيين.
