|a يقوم هذا البحث على الدراسة القضائية لمسألة قضاء رسول الله صلى الله عليه وسلم على اليهود في الحدود حيث يهدف البحث إلى توضيح البينة التي قضى بها رسول الله صلى الله عليه وسلم على اليهود في الحدود، وإلى تبيين حكم قضاء المسلمين على غير المسلمين بشهادة بعضهم على بعض، وإلى بيان واقع الاجتهاد القضائي في المملكة العربية السعودية في قبول شهادة غير المسلم. وقد سلك الباحث المنهج التحليلي: القائم على التفسير والنقد والاستنباط في دراسة المسألة. وخلص بعد الدراسة لعدد من النتائج، منها: أن الراجح قضاء النبي صلى الله عليه وسلم على اليهود في الحدود بشهادتهم، وأن الراجح جواز قبول شهادة غير المسلم على مثله، وأن للقضاء السعودي سلطة تقديرية في قبول شهادة غير المسلم على مثله. وخلصت الدراسة للتوصية بأهمية الدراسة الشرعية للأحاديث القضائية التي تمس الحاجة إليها، مع أهمية ربط هذه الدراسات الشرعية بالاجتهادات القضائية المعاصرة.
|b This research is based on the judicial study of the issue of the verdict of the Messenger of God, may God’s prayers and peace be upon him, on the Jews regarding "Hudoud" (confines). It aims to explain the substantiation that the Messenger of God used to judge on the Jews in relation to confines. In addition, it also aims to clarify the ruling of Muslims judging non-Muslims with the testimony of some of them against each other, as well as to elucidate the reality of judicial assiduities in the Kingdom of Saudi Arabia in accepting the testimony of non-Muslims. The researcher followed the analytical approach based on interpretation, criticism and deduction in studying the issue. After the study, he concluded a number of results, including: it is more likely that the Prophet (may Allah's prayers and peace be upon him) judged on the Jews by their testimony, and that the most correct view is that it is permissible to accept the testimony of a non-Muslim over the same. And, the Saudi judiciary has a discretionary authority in accepting the testimony of a non-Muslim. The study concluded by recommending the importance of legal study of judicial hadiths that are urgently needed, along with the importance of linking these legal studies with contemporary judicial assiduities.
