المستخلص: لا شك أن علم القانون الدولي العام علم جديد وهام ومستحدث، وقد اكتسب أهمية كبيرة في عصرنا الحاضر حيث قامت الدول المستقلة، وانتشرت مبادئ حقوق الإنسان وتشابكت المصالح، وكثرت النزاعات والحروب. فكان لا بد من تقنين قواعد تلزم الدول باتباعها لحل المنازعات والخلافات الحاصلة فيما بينها بالطرق والوسائل السليمة، وليسود الوئام والاستقرار والسلام ربوع المعمورة خاصة وأن العالم قد شهد حربين عالميتين عانت البشرية منهما ومن ويلاتهما الشيء الكثير، لذلك قام الفقهاء بتقنين قواعد للقانون الدولي تتبعه الدول فيما بينها لحل الخلاف والنزاع بالطرق السلمية. لقد اعتمد فقهاء القانون الدولي العام على مصادر التقنين لهذه القواعد التي وصلت إلينا مقننة ومرتبة فاعتمدوا في ذلك على مصادر أساسية وأخرى احتياطية. ولقد قمت بعون الله وتوفيقه بهذا البحث فمهدت لذلك بدراسة لتطور مراحل هذا القانون، ثم بينت كيف تم تدوين هذه القواعد، أما المبحث الأول فجعلته الدراسة المصادر الأساسية لقواعد القانون الدولي العام ودرست فيه؛ المعاهدات، والعرف، ومبادئ القانون، أما المبحث الثاني فكان لدراسة المصادر الاحتياطية لتلك المصادر ودرست فيه؛ الفقه الدولي وآراء كبار الفقهاء، والقضاء الدولي وأحكام المحاكم وأنهيت المبحث بدراسة قرارات المنظمات الدولية.

There is no doubt that the science of public international law is a new, important and innovative science, and it has gained great importance in our present era when independent states have been established, the principles of human rights have spread, interests have intertwined, and conflicts and wars have increased. It was necessary to codify rules obliging states to follow them to resolve disputes and disagreements that occurred among them by sound methods and means, and for harmony, stability and peace to prevail throughout the globe, especially since the world witnessed two world wars from which humanity suffered a lot, so jurists codified rules of international law to be followed by states among themselves to resolve disputes and disputes by peaceful means. The jurists of public international law have relied on the sources of codification of these rules that have come down to us, codified and arranged, so they relied on primary and backup sources. And I, with God's help and success, carried out this research, so I paved the way for that with a study of the development of the stages of this law, and then showed how these rules were codified. As for the first topic, I made it to study the basic sources of the rules of public international law and studied it; Treaties, custom, and principles of law. As for the second topic, it was to study the reserve sources of those sources, and I studied it; International jurisprudence, the opinions of senior jurists, the international judiciary and court rulings. I finished the topic by studying the decisions of international organizations.
