المستخلص: هدفت هذه الدراسة للتعرف إلى طبيعة التحديات التي تواجه أولياء الدم المتنازلين عن القصاص، ودور الخدمة الاجتماعية في مواجهتها وطبقت الدراسة على جميع شيوخ القبائل، ووجهاء الإصلاح في الدم في المملكة، وقد بلغ عددهم (130) فرداً، ومن أهم النتائج فيما يخص العوامل التي تدفع أولياء الدم إلى التنازل عن القصاص: التنازل عن القصاص ابتغاء لوجه الله تعالى، وأن عفو أولياء الدم عن القاتل يحقق مقاصد الشريعة. وأوضحت النتائج أن من أبرز التحديات التي تواجه أولياء الدم المتنازلين عن القصاص: الإحراجات التي يتعرض لها ذوو القتيل من العشائر التي تطلب منهم التنازل، فضلا عن ضعف دور جمعيات إصلاح ذات البين في الحث على التنازل عن القصاص. وتوصلت الدراسة إلى أن أدوار الخدمة الاجتماعية في مواجهة التحديات التي تواجه أولياء الدم المتنازلين عن القصاص تتضمن: تقديم برامج إرشادية موجهة للمجتمع تهدف إلى نشر قيم التسامح، وإعداد مزيد من الدراسات الاجتماعية للتعرف إلى تحديات تنازل أولياء الدم عن القصاص في المناطق المختلفة بالمملكة العربية السعودية. وفي ضوء النتائج أوصت الدراسة بالاحتفاء بالمتنازلين عن القصاص دون مقابل وتكريمهم على أنهم نماذج اجتماعية للاقتداء بها.

This study aimed to identify the nature of the challenges facing guardians of the murder victims to waive of Qesas Penalty and the roles played by social work to address these challenges. The study has been applied to all tribal leaders and key figures who intervene for reconciliation. The number of participants reached (130) persons. Based on the results of the study carried, the factors that drive guardians of the murder victims to waive of Qesas penalty are as follows: • Waiving of Qesas penalty for God’s sake, because the pardon by the guardians of the murder victims may achieve purposes of sharia. In addition to, the results of the study showed the most significant challenges facing the guardians of the murder victims such as: • Embarrassment faced by guardians of the murder victims from tribes, the weakness of the role of reform associations in urging to waive Qesas penalty. • The study showed the roles played by social work to address the challenges faced by guardians of the murder victims who waive of Qesas penalty, as follows: • Conducting Guidance Programmes intended for society with the aim of promoting values of tolerance. • Conducting more social studies to find out the challenges faced by guardians of the murder in different regions of the Kingdom of Saudi Arabia. In view of the results, the study have recommended celebrating those who waive of Qesas Penalty free of charge and honoring them as an example to follow. As well as conducting Guidance Programs intended for society with the aim of promoting values of tolerance, conducting more social studies to find out the challenges faced by guardians of the murder in different regions of the Kingdom of Saudi Arabia.
