المستخلص: يتناول هذا البحث بيان أثر المقاصد الجزئية في قابلية التصرفات للنيابة، وبيان ما يتعلق بالموضوع من: مفهوم المقاصد الجزئية، وحقيقة النيابة، وأقسام التصرفات باعتبار قابليتها للنيابة، وأثر المقاصد الجزئية فيها. ولتحقيق هدف البحث، اتبع الباحثان المنهج الاستقرائي؛ القائم على تتبع واستقصاء المسائل المتعلقة بالمقاصد الجزئية، والنيابة من مظانها. ومن ثم استخدم الباحثان: المنهج الوصفي؛ لتوصيف علاقة المقاصد الجزئية بأقسام التصرفات باعتبار قابليتها للنيابة. والمنهج الاستنباطي؛ لتفسير أثر هذه العلاقة في حكم النيابة في هذه الأقسام. وتوصلت الدراسة إلى أن التصرفات تنقسم باعتبار قابليتها للنيابة إلى قسمين: القسم الأول: تصرفات غير قابلة للنيابة: وهي التصرفات التي تختص حكمتها بصاحبها؛ بحيث لا تحصل مقاصدها الجزئية بمجرد فعلها، بل بالنظر إلى فاعلها، فلا تصح فيها النيابة؛ لعدم تحقق مقاصدها الجزئية بالنيابة. والقسم الثاني: تصرفات قابلة للنيابة: وهي التصرفات التي لا تختص حكمتها بصاحبها؛ بحيث تحصل مقاصدها الجزئية بمجرد فعلها، مع قطع النظر عن فاعلها، فتصح فيها النيابة؛ لتحقق مقاصدها الجزئية بالنيابة -على تفصيل بينته الدراسة-.

This research deals with the effect of partial objectives on the acceptability of in deputy actions, the concept of partial objectives, its reality, the divisions of in deputy actions in terms of its acceptability, and the effect of partial objectives on it. In order for us to achieve this, the researchers followed the inductive approach which is based on investigation of issues related to partial objectives. Then the researchers used: the descriptive approach to describe the relationship of partial intentions to the sections of conduct, considering their ability to be represented. the deductive method to explain the impact of this relationship on the rule of in deputy on these divisions. The study concluded that actions are divided into two parts according to their acceptability of in deputy: those which are not subject to in deputy such actions are particular in wisdom to their agent, wisely reserved for their owner; So that its partial intentions are not achieved by just doing it, but rather by looking at its agent, and the representation is not valid in it; for not achieving its partial objectives. The second section: action subject to representation: they are the actions whose wisdom is not specific to their owner; so that its partial objectives are achieved by the mere act of them, with no regard for its perpetrator, so that the representation is valid here, this is in order to achieve its partial purposes by proxy- as detailed in the study-.
