|b When a collective proceedings is opened, the company goes through a period known as the "period of preparing a solution" or "observation period". During this period, the company's current contracts and the resulting debts are subject to a specific legal system which derogates from the general principles of contract law. However, the exception is employment contracts which are considered as current contracts. Ideed, considering the social nature of labour contracts, they are surrounded by a separate legal protection. Consequently, this paper aims to study the protection that the lawmaker provides to employment contracts during the observation period, that is: the protection they receive when they are maintained and the protection aspects of those contracts when they are interrupted.
|d Lors de l'ouverture d'une procédure collective, l'entreprise passe par une phase dite «phase de préparation de la solution » ou « phase d'observation». Pendant cette période les contrats en cours de l'entreprise et les créances qui en découlent sont soumis à un régime spécifique qui déroge aux principes généraux des droits des contrats. Cependant les contrats de travail qui sont considérés comme des contrats en cours, si on se cantonne à la définition de ces contrats, font l'exception. En effet, étant donné la nature sociale des contrats de travail ces derniers sont entourés d'une protection juridique distincte. Ainsi, cet article a pour objectif d'étudier la protection qu'apporte le législateur aux contrats de travail pendant la période d'observation à savoir la protection dont ils bénéficient lorsqu'ils sont maintenus et les aspects de protection de ces contrats lorsqu'ils sont interrompus.
