يمثل المرشحين الدعامة الأساسية للبناء الديمقراطي في أية دولة، والتي ينبغي أن يرتكز عليها نجاح الانتخابات، فهم من الركائز الأساسية لكل عملية انتخابية فليس هناك انتخابات بدون مرشحين، إذ أن من الممكن إجراء انتخابات بدون أحزاب، ولكن من غير الممكن إجراء انتخابات بدون مرشحين. وحق الترشح للانتخابات صورة من صور المشاركة السياسية للمواطنين في تسيير أمور الدولة، والوسيلة الوحيدة في النظام الديموقراطي التي يستطيع من خلالها المواطن أن يكون شريكاً في إدارة شؤون بلده، وهو حق مكفول دستوريا، كما نصت عليه عدة وثائق دولية، بالإضافة إلى التشريعات التي تولت تنظيم شروط الترشيح. وهذا الحق ليس مطلقا وخاليا من الشروط، بل لا بد من توافر شروط محددة في الفرد ليستطيع أن يرشح نفسه للانتخابات، لكن إن ذلك لا يعني أن توضع أمام المرشح- بحجة التنظيم- شروطا تعجيزية أو غامضة يمكن أن تستخدم لمنعه من ممارسة هذا الحق السياسي الأصيل والمشروع ليتحول من التنظيم إلى منع، مما يؤثر على حرية ونزاهة الانتخابات.
Candidates represent the mainstay of the democratic construction in any country, on which the success of the elections should be based. Candidates are among the main pillars of every electoral process, as there are no elections without candidates, as it is possible to hold elections without parties, but it is not possible to hold elections without candidates. The right to run for elections is a form of political participation of citizens in the management of state affairs, and the only means in a democratic system through which a citizen can be a partner in managing the affairs of his country. And it is a constitutionally guaranteed right, as stipulated in several international documents, in addition to the legislation that regulated the nomination requirements. This right is not absolute and devoid of conditions. Rather, the individual must meet specific conditions in order to be able to run for elections, but that does not mean that incapacitating or ambiguous conditions are placed before the candidate- under the pretext of organizing- that can be used to prevent him from exercising this authentic and legitimate political right.
