المستخلص: إن مبدأ التداول السلمي للسلطة من المبادئ المهمة في القانون الدستوري لما له من أثر فعال في عدم احتكار حزب أو كتلة أو حاكم معين بالسلطة والاستئثار بها، مما يؤدي إلى بشكل أو بآخر إلى قيام النظام الدكتاتوري وتهاوي النظام الديمقراطي، فلا يملك الشعب عندئذ محاسبة أي ممن يمسكون بزمام السلطة. أن الديمقراطية تقتضي أن يكون الشعب هو صاحب السيادة ومصدر السلطات ولذلك فان الدساتير في الدول القائمة على أساس الديمقراطية تشير إلى هذا المبدأ المهم فليس الحكام سوى ممثلين عن الشعب في أدارة الشؤون العامة سواء كان ذلك على صعيد السلطة التشريعية أو السلطة التنفيذية فالشعب باق والحكام يتعاقبون، فالشعب هو صاحب الاختصاص الأصيل يختار من يشاء من الكتل أو الأحزاب السياسية لإدارة الحكم فيعطي ثقته لمن يقتنع ببرامجه ومشاريعه السياسية ويحجب هذه الثقة عن من يجده قد أخفق في تحقيق ما يصبو إليه الشعب في تطلعاته وهذا هو جوهر التداول السلمي للسلطة إذ يقتضي هذا المبدأ أن يقوم الشعب بتنحية الحكام من سدة الحكم والمجيء بحكام جدد وهكذا تستمر الحياة السياسية.

The principles of democracy require that the people be the owner of sovereignty and the source of authority. Therefore, constitutions in countries based on democracy refer to this important principle. The rulers are nothing but representatives of the people in the management of public affairs, whether at the level of the legislative authority or the executive authority. The people are the original competence holder to choose whomever they want from the political blocs or parties to administer the government. That the people remove the rulers from the heights of power and bring new rulers and this is how political life continues The principle of peaceful transfer of power is one of the important principles in constitutional law and political systems because of its effective effect in not monopolizing power by a particular party, bloc, or ruler, and monopolizing power, which leads in one way or another to the establishment of the dictatorial regime and the collapse of the democratic system. Any of those who hold the reins of power We will address the principle of rotation of power in the Constitution of the Republic of Iraq for the year 2005 in this research through three demands, we devote the first requirement to the concept of rotation of power, and in it we deal with the meaning of the rotation of power in the first section. The means of transferring power, namely the election and the referendum, through two branches. As for the third requirement, we will devote it to clarifying the guarantees of power rotation.
