المستخلص: حق الانتخاب يشكل حق أساسي في المواثيق الدولية والإقليمية، لذا اتجه المشرع العماني وبإطاره الوطني لتنظيمه ومنع مصادرته، فأصدر القوانين وللوائح لتنظيم ممارسته، وتماشياً مع التطور التقني الذي يجتاح العالم، كان لا بد من تنظيم ممارسته في الفضاء الإلكتروني، لهذا أسندت اللائحة التنظيمية للمجلس البلدي لعام 2022م الاختصاص للجنة الرئيسية للانتخابات إقرار تنظم التصويت عن بعد، فجاء قرارها إن يكون التصويت بوسيلة الهاتف الذكي عن طريق تطبيق (انتخب) ولم تقرر نظاماً مساعداً لمن ليس لديهم المعرفة في استخدام هذه البرنامج، أو لمن ليس لديهم القدرة لامتلك الهاتف الذكي. مما يدفعنا للتساؤل: ما مدى فعالية استخدام برنامج انتخب في تحقيق التوازن بين حماية حق الانتخاب وبين حماية المصلحة العامة؟ اعتمد الباحث على المنهج الوصفي التحليل من خلال تحليل النصوص المتعلقة بحق الانتخاب، مستعينين في ذلك بالمنهج المقارن للتعرف على العيوب والميزات بين انتخابات المجلس البلدي في الفترة الثانية 2016 وبين انتخابات المجلس البلدي في الفترة الثالثة 2022، وقد توصل الباحث للعديد من النتائج أهمها: إن هناك زيادة في المشاركة في انتخابات المجلس البلدي للفترة الثالثة بنسبة زيادة مقدارها (4.3%) بالمقارنة بانتخابات المجلس البلدي للفترة الثانية 2016.

The right to vote is a fundamental right in international and regional conventions, so the Omani legislator and its national framework to regulate it and prevent its confiscation, issued laws and regulations to regulate its practice, and in line with the technical development sweeping the world, it was necessary to organize a practice in cyberspace, so the regulation of the Municipal Council for 2022 assigned competence to the Main Committee for Elections to approve the regulation of remote voting, so its grandfather decided that voting should be by means of a smartphone through the application "Intakhib" (to Elect) and did not decide an auxiliary system for those who do not have knowledge in the use of this program, or for those who do not have the ability to own a smartphone. The main question is, how effective is the use of "Intakhib" App in making balance between the protection of the right to vote and the protection of the public interest? The researcher relied on the descriptive approach through the analysis of texts related to the right to vote, using the comparative approach to identify the disadvantages and advantages between the municipal council elections in the second period 2016 and the municipal council elections in the third period 2022. The researcher reached several results, the most important of which are: There is an increase in participation in the municipal council elections for the third period by an increase of (4.3%) compared to the municipal council elections for the second period 2016.
