المستخلص: يعد كتاب أقضية رسول الله (صلى الله عليه وسلم) لابن الطلاع (ت497ه) من المصادر التي اعتنت بأمر القضاء في الإسلام، حيث جمع فيه المسائل التي قضى فيها النبي (صلى الله عليه وسلم) أو أمر بالقضاء فيها، وهو نموذج مجسد للمقاصد الشريعة التي تهدف إليها النصوص. الشريعة الإسلامية جاءت لتحقيق مصالح العباد في الدنيا والآخرة، فقد جاءت لحفظ الدين والنفس والعِرض (النسل) والعقل والمال، فهذه هي المصالح التي تدور حولها جميع مصالح العباد، فحفظ هذه المصالح سبب لعمارة الأرض كما أراده سبحانه وتعالى. وقد حصن الإسلام بقاء الأسرة لبقاء استمرار البشرية من خلال الزواج، لذلك تحظى أحكام الزواج بأهمية كبيرة لشمولها وآثارها العظيمة على الفرد والمجتمع، وهنا تبرز أهمية أقضية رسول الله (صلى الله عليه وسلم) في مسائل الزواج، فاستنباط المقاصد الشرعية من قضائه (صلى الله عليه وسلم) في كتاب أقضية رسول الله (صلى الله عليه وسلم) في مجال الأحوال الشخصية هي الخطوة الصحيحة للوصول إلى معرفة المقاصد العليا للشريعة.

The Book of “Verdicts of the Messenger of Allah (May Almighty Allah bless Him and Grant Him Peace)” by Ibn Al-Tala’ (Died in 497 AH) is one of the sources that dealt with the issues and matters of the Judiciary in Islam, as it collected the issues in which the Prophet (May Almighty Allah bless Him and Grant Him Peace) ruled or ordered judgment to be made, and it is a model that embodies the Sharia objectives that the texts aim at it. The Islamic law came to achieve and realize the interests of the servants in this world and the hereafter. It came to preserve the religion, the soul, the honor (offspring), the mind, and the money. These are the interests around which all the interests of the servants revolve. Preserving these interests is a reason for building the earth as the Almighty Allah intended. Islam has fortified the survival of the family in order for humanity to continue through marriage. Therefore, the verdicts on marriage are of great importance due to their comprehensiveness and great effects on the individual and society. Here the importance of the verdicts of the Messenger of Allah (May Almighty Allah bless Him and Grant Him Peace) in the issues of marriage is highlighted, to conclude the legal objectives from his verdicts (May Almighty Allah bless Him and Grant Him Peace) in the book The Verdicts of the Messenger (May Almighty Allah bless Him and Grant Him Peace) in the field of personal status is the right step to reach knowledge of the higher purposes of the Sharia law objectives.
