المستخلص: تتجلى أهمية الطفولة كمرحلة عمرية في كونها أساساً في بناء شخصية الطفل اللاحقة، وتعتمد عليه إنتاجيته وعطاؤه المستقبلي، وقد اهتمت الدول والمنظمات بوضع التشريعات والقوانين التي تضمن حقوق الأطفال وتبذل جهودا عديدة في هذا المجال، وتقدم تقارير منتظمة حول الاهتمام بتطبيق هذه الحقوق والتشريعات، كما تحفل الدراسات والموسوعات والمصادر التربوية والإسلامية ببنود حقوق الطفل والقوانين المنظمة لها ومدى الوعي بها واستخدامها وتطبيقها. وقد أولت سلطنة عمان اهتمامها الخاص بالطفولة من خلال الإدراك بأهمية زيادة مؤسسات تنشئة الطفولة مثل دور الحضانة وأركان التعليم المخصصة للأطفال في المحافظات، وتهيئتها لتتوفر بها أجود المعينات اجتماعيا وثقافياً تعلمياً باستخدام طرق التعليم المناسبة، فتعتبر أولى سنوات حياة الطفل مهمة لأنها تمثل بدايات بناء الشخصية وإكساب مهارات القدرة على التكيف الاجتماعي والبيئي، كما تتوقف عليها مقدرة الطفل على تكوين العلاقات الاجتماعية ليتواصل مع الآخرين وخاصة من هم في عمره، مما يحقق لديه شعور بالاطمئنان لنفسي والشعور بالاستقرار و الثقة. وقد خطت السلطنة خطوات حثيثة في الاهتمام بحقوق الطفل في العقود الأخيرة حيث قامت بالتوقيع مع باقي دول العالم على اتفاقية حقوق الطفل عام 1996، وسنت قانونا للطفل العماني سنة 2014 ثم صدرت لائحته التنفيذية، وكذلك تم إنشاء لجان حماية الأطفال في مختلف المحافظات كما أطلقت خدمة الخط الساخن لحماية الطفل في عام 2017. والموسوعات الفقهية العمانية باعتبارها مصدرا أساسيا للمتخصصين والدارسين تفرد فصولا لتفنيد قضايا الأطفال والتعامل معهم وتنفيذ حقوقهم، ويعد كتاب الضياء للعوتبي من أهم الموسوعات الفقهية العمانية التي شملت جوانب وقضايا فقهية وتشريعية متعددة ومنها القضايا المرتبطة بالأسرة والتعامل مع الأطفال. تعتمد هذه الدراسة المنهج التحليلي لتقيس مدى تضمين حقوق الطفل في كتاب الضياء للعوتبي باعتباره إحدى أمهات الموسوعات الفقهية العمانية.

The importance of childhood as a developmental stage is manifested as it serves as the foundation for shaping the child's subsequent personality, productivity, and future contributions. Nations and organizations have shown considerable interest in establishing legislation and laws to ensure children's rights and have made numerous efforts in this regard. They regularly provide reports on the implementation of these rights and regulations. Studies, encyclopedias, educational, and Islamic sources are replete with articles on children's rights, organized laws, awareness, utilization, and implementation. Oman, in particular, has shown special attention to childhood by recognizing the importance of increasing child rearing institutions, such as nurseries and dedicated educational facilities for children in various provinces. These institutions are equipped with the best social, cultural, and educational resources to facilitate children's development. The early years of a child's life are critical as they represent the foundations for personality development and the acquisition of social and environmental adaptation skills. These years are also crucial for a child's ability to form social relationships, especially with peers of the same age, which fosters a sense of self-assurance, stability, and confidence. In recent decades, Oman has taken significant steps in caring for children's rights. It signed the Convention on the Rights of the Child in 1996 and enacted the Omani Child Law in 2014, followed by the issuance of its implementing regulations. Furthermore, child protection committees have been established in various provinces, and a child protection hotline service was launched in 2017. Omani jurisprudential encyclopedias, as primary sources for specialists and scholars, have dedicated sections to address children's issues, interactions with them, and the enforcement of their rights. The book "Al-Dhiya" by Al-'Utabi is considered one of the most important Omani jurisprudential encyclopedias, covering various jurisprudential and legislative aspects, including issues related to the family and the treatment of children. This study employed an analytical approach to assess the extent to which children's rights are included in "Al Dhiya" by Al-'Utabi, given its significance as one of the foundational Omani jurisprudential encyclopedias.
