المستخلص: هذا البحث بعنوان (تتبعض الأحكام بحسب تفاوت أسبابها) وتطبيقاتها الفقهية، وهي قاعدة فقهية لطيفة تدل على كمال الحكمة في الشريعة الإسلامية؛ حيث تعطي لكل شيء قدره، وتحقق مصالح الناس، ولها العديد من المسائل المتناثرة في أبواب الفقه. وقدا جاء هذا البحث في مقدمة وأربعة مباحث وخاتمة. أما المقدمة فاشتملت على أهمية الموضوع، وأسباب اختياره، وخطة البحث، والمنهج المتبع فيه. المبحث الأول: التعريف بالقواعد الفقهية وأهميتها. وفيه مطلبان: المطلب الأول: التعريف بالقواعد الفقهية لغة واصطلاحا المطلب الثاني: أهمية القواعد. المبحث الثاني: الفرق بين القواعد الفقهية وغيرها من المصطلحات ذات الصلة، وفيه أربعة مطالب: المطلب الأول: الفرق بين القاعدة الفقهية والضابط الفقهي. المطلب الثاني: الفرق بين القاعدة الفقهية والقاعدة الأصولية. المطلب الثالث: الفرق بين القاعدة الفقهية والنظرية الفقهية. المطلب الرابع: الفرق بين القاعدة الفقهية والأشباه والنظائر. المبحث الثالث: قاعدة (تتبعض الأحكام بسبب تفاوت أسبابها) وفيه ثلاثة مطالب: المطلب الأول: معنى القاعدة. المطلب الثاني: مكانة القاعدة. المطلب الثالث: أدلة القاعدة. المبحث الرابع: التطبيقات الفقهية لقاعدة (تتبعض الأحكام بسبب تفاوت أسبابها) ثم الخاتمة ذكرت فيها أبرز ما توصلت له من نتائج.

This research is entitled (rulings vary according to the varying causes) and their jurisprudential applications. It is a nice jurisprudential rule that indicates the perfection of wisdom in Islamic law. It gives everything its value, achieves people's interests, and has many issues scattered in the chapters of jurisprudence. This research has an introduction, four chapters and a conclusion. As for the introduction, it included the importance of the topic, the reasons for its selection, the research plan, and the methodology used in it. The first topic: the definition of jurisprudential rules and their importance. And there are two requirements: The first requirement: definition of jurisprudential rules linguistically and idiomatically The second requirement: the importance of rules. The second topic: the difference between jurisprudential rules and other related terms, and it has four demands: The first requirement: the difference between the jurisprudential rule and the jurisprudential officer. The second requirement: the difference between the jurisprudential rule and the fundamentalist rule. The third requirement: the difference between the jurisprudential rule and the jurisprudential theory. The fourth requirement: the difference between the jurisprudential rule and similarities and analogues. The third topic: the rule (rulings are invalid due to the disparity of their reasons), and it has three demands: The first requirement: the meaning of the rule. The second requirement: the status of the base. The third requirement: Al-Qaeda evidence. The fourth topic: the jurisprudential applications of the rule (rules are invalid due to the varying causes) Then the conclusion mentioned the most important findings.
