المستخلص: بعد الاعتداءات التي تعرض لها العقار الفلاحي والتي لازال يتعرض لها من تغير لوجهته وجعله وعاء للعقارات الصناعية والسكنية سن المشرع الجزائري جملة من القوانين والتعليمات التي من شأنها أن توفر الحماية لهذه الثروة الطبيعة التي تتطلب حماية وعناية خاصة، صحيح أن العقار الفلاحي أصناف وأنواع إلا أن المشرع لم يفرق بين أرض مرتفعة الخصوبة وأرض متوسطة الخصوبة أو أرض ملك للدولة أو أرض ملك للخواص إذ العقار الفلاحي يبقى فلاحي ويحاج إلى حماية، ومن خلال البحث تبين أيضا أن الفقه الإسلامي هو الآخر قد كان سباقا لعلاج هذه الظاهرة وأوجد طرقا لحماية هذه الثروة الطبيعية التي تؤمن غذاء الناس وتظم استمرارهم بشكل طبيعي.

After the attacks on agricultural real estate which it is still subjected to by changing its direction and making it a container for industrial and residential real estate the Algerian legislator enacted a set of laws and instructions that would provide protection for this natural wealth that requires protection and special care. It is true that agricultural real estate is varieties and types. but the legislature he did not differentiate between land of high fertility and land of medium fertility. or land owned by the state. or land owned by the private. as the agricultural property remains agricultural and needs protection. Food for all people and regulate their continuation naturally.

Après les atteintes dont la propriété agricole a été victime et dont elle fait encore l'objet en changeant sa destination et en en faisant un conteneur pour l'immobilier industriel et résidentiel, le législateur algérien a édicté un certain nombre de lois et d'instructions qui assureraient la protection de cette richesses naturelles qui nécessitent une protection et des soins particuliers. Il n'a pas fait de distinction entre les terres à fertilité élevée et les terres à fertilité moyenne, ou les terres appartenant à l'État, ou les terres appartenant à des particuliers, car la propriété agricole reste agricole et a besoin de protection. et leur continuité s'organisent naturellement.
